Yuba City(CA) Pays Man To Stop Frivolous ADA Lawsuits

A disability debacle is playing out in Yuba City as officials are paying a man to stay away. And because of it, he’s cashing in.

Yuba City officials say the man is attacking small business owners with frivolous lawsuits.

This settlement agreement is the first of its kind in the state, and while it does give the city and businesses a moment of relief from one man, it also opens the floodgates for others to cash in on their decision.

Owners of JJ’s Tools and Merchandise shop off Gray Avenue say they are relieved a notorious local man will not be able to target their business over Americans with Disabilities Act compliance laws.

“We’d probably have to close it down. We do not have the capital; we’re barely breaking even,” owner Jayne Sawyer said.

The city agreed to pay George Louie $15,000 for him to stop bringing frivolous lawsuits against them and area businesses.

Living an hour away from where this debacle is unfolding, I hope my home town is preparing for the flood gates to be full open. We have a similar person here in Chico, CA, who has filed one frivilous suit after another using ADA as a pretense. Given our extremely liberal city council members, who have nearly bankrupt Chico already, I don’t hold out much hope that this won’t happen here also.

There’s a woman in the Gettysburg, Pennsylvania area who does the exact same thing through the commonwealth’s “Human Rights Commission”, and has forced a number of small businesses to either spend up to $30,000 each installing ramps and wheel chair elevators, or close their doors for good. Several took the latter option, while another one (a friend of my wife) laid off all her employees, installed the required ramp, and then scaled her hours back to 3-9 per week. It’s a real travesty.

Arctic Circle closes due to ADA lawsuit

Jason Singleton was the attorney who filed a whole spate of these lawsuits for a while here. Haven’t heard anything about him for a while. Probably moved over there.

Paying them off seems like setting a bad precedent. That said, found this little gem on wikipedia...

In the United States, Rule 11 of the Federal Rules of Civil Procedure and similar state rules require that an attorney perform a due diligence investigation concerning the factual basis for any claim or defense. Jurisdictions differ on whether a claim or defense can be frivolous if the attorney acted in good faith. Because such a defense or claim wastes the court's and the other parties' time, resources and legal fees, sanctions may be imposed by a court upon the party or the lawyer who presents the frivolous defense or claim. The law firm may also be sanctioned, or even held in contempt.

I have a well publicized personal experience with the Fraudulent ADA law.. This disastrous law has turned into a crime wave..

Is it any wonder why people hate Law-your’s?

I've said for the last 10 years that every family should have at least one member that is an attorney because given how easy it is to sue based on absolutely nothing.

Indict a ham sandwich and all that...

It is knuckleheads like this that make things difficult for those of us who have a disability. I see it all the time.
As for Yuba City — get yourself some decent attorneys who actually know the ADA because it specifically states that no business should be made to anything that would cause undue harm to the business or the facility.

Yuba City is being taken for a ride by extortion artists.

There was another one of those scum who filed against my favorite steak house, The Hitching Post, in Casmalia, CA.

They posted on their web site the guy had filed over 500 ADA lawsuits.

Has anybody sued the Federal government challenging the law itself as unconstitutional? It violates the 5th because it is a taking, it violates the 1st becasue it violates freedom of association and it violates the tenth, by giving a power to the feds which is reserved for the states. If nothing else businesses threatened by this awful law could band together and challenge it, on mass, and keep the matter tied up in court for decades.

Indeed.. The real tragedy is the boy at the center of this mess was a nice kid that had been a IV drug user at 12yrs old and had turned his life around, but later discovered he was infected..

He died within a year of this scandal.. He apologized to me and told me that they threatened to keep him from free medical treatment.. Cruel bastards..
