This should not be in the supreme court. This should not be even debated. Race-based preferences are illegal, unconstitutional, and morally wrong, and have been from the start.
What’s so hard to understand:
There is nothing “affirmative” about so-called “Affirmative Action.” It’s STATE-SANCTIONED RACISM. End of story.
Unlike arbitrary discrimination by individuals in a free-speech society, this is FASCIST in that it allows the Gov’t to be an agent of discrimination (for and against individuals).
Shame on those who believe this tripe packaged as something “positive.” There’s nothing positive about affirmative action.
I’d love for the government to add to the “questions potential employers are not allowed to ask” any question regarding race.
