Massachusetts high court hears Springfield gun case

BOSTON – Arguments in the case of a retired Air Force captain from Springfield charged with a gun violation were heard by the state’s highest court Monday.

A lawyer for John McGowan of 15 Garland St., argued that his client took all required precautions to store his gun on Oct. 19, 2008 when city police visited his home and charged him with improper storage of a firearm.

Judges in the state’s Supreme Judicial Court are expected to render a decision in the coming months.

According to court papers, McGowan’s girlfriend took his gun from the nightstand next to his bed back in October 2008 and threw it into the bushes outside his home.

With Heller and McDonald, it is hard to see how a state can require handguns to be unloaded and/or locked up in the home.

Yep! The “Keep and Bear” phrase in the 2nd Amendment suggests that arms should be at the ready at all times. Laws that require that firearms restrictions (locks, safes, etc) are infrindgements of this most basic and important right.

My new Ruger revolver came with a huge lock in the box. This is Texas and I haven't even picked up the lock. I'd get killed (brains eaten) six times over if I had that huge lock on my gun when a zombie broke in. What's the use of having a weapon if you can't use it fast?

“Hey, there, zombie, wait until I get this lock off and I'll shoot you in the head.”

Yep.... Some common sense in Texas re firearms. Here in Cali I’m a scafflaw...... I Keep all of my pistols “condition 3.” loaded mag in....all I need to do is pull the slide and commence defending myself!

Everytime I see an Obama add, I think of the Hitler youth.

If I were wealthy, I would run the Hitler youth adds from the fourties on TV, every day, subtitled, “FOREWARD”

Improper storage?

In my home that would mean having to take more than 5 steps in any direction to a locked and loaded firearm of some type.
