Also from the article..... One uncertainty hanging over the case is whether Loughner will face state charges. The plea agreement to the federal charges makes no mention of that possibility.

Pima County's top prosecutor said last year that she may file state charges in the case that could carry the death penalty. In an agreement with federal prosecutors, County Attorney Barbara LaWall agreed that the federal prosecution would take place before she could bring charges.

LaWall has been unavailable in recent days, and officials in her office have repeatedly declined to comment, saying the office did not have an active prosecution against Loughner.

A state prosecution after a successful federal one would not be unprecedented. Oklahoma City bombing conspirator Terry Nichols avoided the death penalty on federal charges after a 1997 trial and was given a life sentence. State prosecutors then tried him again, but a state jury also declined to sentence him to death. While it is my opinion that Loughner deserves to be put to death for his actions, I do agree to this outcome if all relevant victims agree since it releases them from years of legal conflict. However, I do have concerns about one legal point- the fact that the act committed was in violation of federal laws, which this trial was all about, and also in violation of State laws, which Loughner can possibly be tried for, seemingly placing him in jeopardy twice for his crime in direct contradiction of amendment V of the US Constitution. Can anyone explain to me why this is not so?

All the news is about wounding this Gabby Giffords, and mentions in passing he KILLED 6 other unnamed people.

One was the Federal Judge down there. But Gabby was/is a D and that is all that matters to media.

The guy killed 6 people, they feed him tranquilisers for 6 months and then decide to let him live.

He needs to be executed and soon.

The death penalty is not a deterrent because we so seldom use it and wait 20 years to do it.

California has 600 on death row who will die a natural death long before they are executed.No wonder it isn’t a deterrent.
