I just wonder WTH is wrong with Thomas, Scalia et al that they failed to see the genius of John Roberts.

Yes, he borders on the wisdom of Solomon. Unlike Solomon, however, he cut the baby in half before proposing it as the solution. Just needs a little fine tuning.

There really was no need to “play” here. There may be a salutory side effect from Roberts’ brain game, but writing crap like that (pardon my french) into case law is just too, too gauche.
