Madison - Justice David Prosser has now asked all his colleagues on the state Supreme Court to step aside in his ethics case.
One justice has already recused herself, and Prosser is not expected to participate in the case. If two others remove themselves, the case will effectively end because at least four of the court's seven justices are needed to take any action.
Prosser is accused of violating the state ethics code for judges by putting his hands on the neck of Justice Ann Walsh Bradley after she confronted him face to face in her office in June 2011. Prosser contends Bradley approached him with her fist raised - a claim she denies - and that he touched her neck when he put up his hands in a reflexive defensive move.
Prosser said shortly after the allegation was filed in March that he would ask other justices to step aside because they participated in the incident, witnessed it or learned of it shortly afterward. Soon after the filing against him, he began formally asking justices to recuse themselves, and he made his final request Monday to Justice Annette Ziegler.
Justice Patience Roggensack stepped aside in the case in May. The other justices have not said what they will do.
The accusations were brought by the state Judicial Commission, which initially supported the filing on a 6-0 vote but later split 3-3 on whether to reconsider it.

Prosser's case remains stalled because the Supreme Court has not told the appeals court chief judge, Richard Brown, to create the panel.

OMG [not a term I use often]! I thought this was over and done with, oh, I don’t know, a year ago. I can’t believe this poor guy is still fighting for his reputation.
He should have knocked her teeth down her throat when she attacked him. He would basically still be in the same situation except he would get the satisfaction of watching that lying leftist trash gum her way through the rest of her life.
