You can't blame this on Roberts.

Kennedy would have voted to toss the whole thing without Roberts siding with him on the parts that were struck down.

That would have caused a 4-4 split and allowed the lower court ruling to stand, and that killed the whole thing.

One of the RATS didn't vote on it. Kennedy is to blame for this one.

kennedy is guilty but I read the roberts opinion and he is not the jurist that he claimed in his Senate hearings. I blame him for being a progressive jurist that made an unconstitutional decision. Mark Levin said this yesterday also. I am in good company in my opinion. Scalia wasn't happy either.
