Court's Obama order a 'hissy fit'

(CNN) The Fifth Circuit's homework assignment to the Department of Justice is a disgrace -- an embarrassment to the federal judiciary. Still, it's a useful window on the contemporary merger of law and politics.

This is not judging. This is a judicial hissy fit. The Supreme Court will determine the constitutionality of the health care law, and the president will, as he must, abide by that judgment whether he agrees with it or not. In the meantime, however, the president, like all Americans, enjoys the right to express himself on what the court should do in that or any other case.

With its petulant order to the Justice Department, the Republican judges performed a peculiar, if useful, kind of service to the public -- reminding us of the partisan nature of much of the federal judiciary. The Supreme Court's decision in the health care case may offer a similar lesson.

Toobin is a joke. He can only predict the past and even then can’t understand it.

Judges are moody, Judges are contol freaks, and judges rule their courtrooms.

If this was ANY other lawyer there would have been a rule to show cause for contempt.

No, Jeffrey, it isn’t a ‘hissy fit’. It is a less-than-subtle admonition to the DOJ’s boss - Obama, that he is an incompetent lying fool (his supporters are even bigger fools for believing what he says). Constitutional Law Professor Obama (aka known as a goddam token TA instructor in a podunk law school ridden with political bent) doesn’t know his ass from a hole in the ground when it comes to Constitional Law. He only knows how he wants to neuter it.

There are TWO purposes of the Supreme court according to the US Constitution: 1) to determine the constitutionality of legislated laws, and, 2) to resolve disputes between Sovereign states.......something so easy it’s a wonder how this simp didn’t learn......wait a minute, possibly he wasn’t learning US Constitutional law while he was busy praying to Allah in Indonesia or learning how to destroy this country in Pakistan.

This man is a goddam train wreck for America. Are liberals and blacks SO willing to fulfill their power/control trips and just plain ‘getting paid’ to ignore what the hell he is?

I can understand a Muslim America Hater and the people who selfishly voted him in office, Jeffrey, but for the life of me I can’t understand why the hell a supposed liberal media analyst doesn’t even understand just what the hell the purpose of the Supreme Court is! Go f@ck yourself.

I honestly don’t know the status of BO’s law license. I know Michelle’s is “voluntarily surrendered” which just means “I’m not working and don’t want to pay my bar dues or take CELs.”

I do not accept your guess at what Michelle’s loss of law license “means” (something innocuous or innocent). Better to stick with “I don’t know”, and I don’t either. That is the point. Media should find out what it means and explain it. If Ron Paul’s medical license was invalidated, you can bet the DBM would ask why and make sure response was accurate ala GWB’s TANG records. Law licenses are often “surrendered” to stave off or in lieu of disciplinarty or other (e.g. criminal) punitive actions.

I order your opinion thrown out of court. I further order you to write a three-page letter to this board, single-spaced, explaining in detail why Judge Smith has abused his judicial discretion....and post it here within 48 hours.

I actually agree with Toobin, here. The Court really has no say on asking the Justice department to justify President Obama's simple remarks. The remarks were, obviously, out of bounds and wrong on about three levels, but they are 1st-Amendment-protected speech of an individual. Asking an agency to justify those remarks was, frankly, silly.

It is a sign of the odd times we live in, no doubt -- but the role of criticism of Obama's bizarre comments should be left to opposition members and pundits.
