Judicial misconduct alleged in North Carolina (DukeLax Frame tie-in)

An extraordinary legal shouting match has broken out in Durham, N.C., between the county’s beleaguered local district attorney and its senior Superior Court judge, who has chastised the D.A. in open court.

In a harshly worded court filing, Durham Dist. Atty. Tracey Cline accused Judge Orlando F. Hudson Jr. of "moral turpitude, dishonesty and corruption" and complained that the judge "harbors animosity" toward her and has engaged in "retaliatory conduct" and "gross misconduct."

Court filings are typically written in dry, obtuse legal argot. But Cline’s filing contains unusually accusatory and vituperative language replete with fractured syntax and spelling errors. She wrote that Hudson’s actions "striped away" her rights, and that credibility of the criminal justice system is a "causality" of Hudson’s conduct. She described Hudson’s behavior as "without responsibility or conscious."

Saying crime victims have been "emotionally and relentlessly repeatedly raped" by the judge’s rulings, Cline said she will attempt to have Hudson removed from overseeing criminal cases. She also wrote that she has filed a misconduct complaint against Hudson with the state commission that oversees judges.

Cline's filing, submitted late Thursday, accuses Hudson of "intentional and malicious acts with GROSS UNCONCERN for this conduct and done in BAD FAITH."

Hudson, the senior resident judge in Durham since 1995, has dismissed murder charges in two cases prosecuted by Cline’s office. The judge has ruled that Cline "flagrantly violated" a defendant’s rights in one case, in which Hudson said Cline deliberately misstated facts in court. Cline was elected district attorney in 2008, after former Dist. Atty. Mike Nifong was removed from office and disbarred for falsely accusing Duke University lacrosse players of raping a stripper. Cline was reelected last year after running unopposed.

Long-time followers of The DukeLax Frame will recognized these two names. Cline was Nifong's deputy and Hudson is one of the buffoon judges in Durham.

Yep. That’s how we roll here in Zimbabwe With a Ballpark.

I sat on a jury here four years ago. The Durham PD and the DA took what looked like a slam-dunk prosecution for possession of crack with intent to distribute and totally blew it. It took us less than an hour to find the defendant innocent on all charges, thanks to the DPD’s and FBI’s utter incompetence. The DPD, the DA’s office, the judges, all of them seem to be either corrupt or incompetent. But that’s to be expected in the land of one-party rule and where race trumps everything.

One of the stupidest things I ever did in the 1970s was to help a young black guy fill out an application to be a teacher in some miserable Deep South school district looking for black applicants. He got the job.

He was a very sweet person, was actually graduating from a local college...but had fifth grade writing skills at best and had probably only gotten through college by having friendly white people do his work for him.

I thought he might be good for the kids because he was a genuinely nice person. But sadly, I think that I probably just helped perpetuate black quasi-literacy, to the great detriment of people who probably would have been smart enough to actually make it on their own if they had been taught by qualified people (of any color) and held to the same standards as people of any color.

I once helped a Black Lawyer fill out a fairly routine federal tax form. He had a degree from Yale and is now a federal judge.

The guy actually wasn’t dumb but I still thought it odd that a lawyer needed help filling out a form.

I made the mistake of moving to North Carolina.
I quickly moved back to Florida, as soon as I could.
I was there when the “Duke” case started.
Drugged out black stripper hooked up with dirty liberal DA running for another term of office in Durham, and the entire local “government” fully expected the innocent wealthy young white men to meekly allow themselves to be railroaded by blatantly false public accusations of rape.

Nifong expected them to quietly settle out of court, after he and the stripper dragged them through public media hell for their own purposes.
Surprise!
The men fought back.
It is very important to note that the accused were not merely adjudicated “not guilty”, they were judged to be innocent, and were cleared of all charges.
They were also proclaimed by the court to be victims of serious prosecutorial abuse, committed by the DA, Nifong.

IMHO, the same insane mentality is in play against Herman Cain.
He needs to fight back hard against the false political premise that unproven “accusations” equal truth,or justice.

Seriously, how do these people, and for that matter, Barack and Michelle Obama, pass the bar exam? Is there rampant cheating going on? Do they pay others to take the exam for them? Does a sympathetic political ally “fix” the results? I really cannot figure it out.

I’ve heard of cases or laws being thrown out because of a misplaced comma, I guess these spelling errors are okay though?

The Grammar Police should arrest that crazy lady. lol
