Thirty-seven Republican House members are challenging the two-year prison sentence being served by a U.S. Border Patrol agent for his conduct in the arrest of a drug-smuggling suspect, while a dozen other lawmakers are pressing Attorney General Eric H. Holder Jr. to explain his role in the botched Fast and Furious weapons investigation.
In a letter Thursday to President Obama, the 37 members led by Rep. Duncan Hunter of California described the prosecution of Agent Jesus E. Diaz Jr. as unfair and excessively disproportionate and suggested it set a dangerous precedent that could place other agents and the public at risk.

In the letter, the lawmakers noted that Diaz had been cleared of any wrongdoing by the Department of Homeland Securitys Office of Inspector General and U.S. Customs and Immigration Enforcements Office of Professional Wrongdoing. It said only a contradictory report from the Internal Affairs Division at U.S. Customs and Border Protection provided the basis for prosecution, noting that that report came a year after the agent had been cleared.
The letter also questioned the credibility of the governments main witness, the smuggling suspect, who testified under a grant of immunity. It asked the president to consider whether the two-year sentence was justified and how the case has an impact on an agents ability to do his or her job.

I am so glad to see the emergence of some backbones.
It’s about D*** time.
Its about D*** time.
Amen to that! If the GOP doesn't start investigating these type fiascos Obama and thugs will turn this country upside down, more so than they already have.
“...questioned the credibility of the governments main witness,
the smuggling suspect, who testified under a grant of immunity...”

Well, there ya’ go!
Sounds like a super credible guy to me (not).
It makes me sick how they protect the Cartels and their mules.
It’s going to take enormous work to clean up the mess this Administration has created.
So let me get this straight.
Border patrol caught a Cartel drug mule with several hundred pounds of pot.
The BP agent lifts the uncooperative cartel mule by his handcuffed arms to get him to comply.
BP agent goes to jail and Cartel mule goes free with immunity.
Someone involved in prosecuting this case is on the payroll of the Cartels
It really does sound like that. The only other explanation I can think of is America’s enemies are now running the country and are making sure that America’s friends are punished every time they can.
“...Americas enemies...”
Obama, Holder, Reid, Pelosi...their stooges in Congress...and all the RINO’s...
This Administration is playing for the other side.
In fact, it’s playing for several multiple other sides, all at the same time.
Testimony of a lying drug smuggler crossing border illegally versus the testimony of 7-year Border Patrol Agent Diaz.
No witnesses??? No marks on the smuggler's body, except from the straps of the pack that held the drugs. Diaz cleared by two US agencies---and DOJ gives the lying drug smuggler immunity to hang the BP agent?
And a judge (???) convicts BP agent Diaz with TWO YEARS for violating the illegal-border-crossing, lying drug smuggler's civil rights and using excessive force???
"The teenager also said he did not know anything about the drugs reportedly being carried into the United States, although the U.S. attorneys office on the day of the Diaz sentencing said that during the trial, the teenager had admitted that he was smuggling marijuana at the time he was apprehended."
Smuggling suspect got immunity in case of convicted border agent

No law-abiding American citizen is safe from the prosecutorial arm of a lawless and corrupt Federal Government if he gets in the way of leviathan's lawlessness and corruption.
