New California law bars E-Verify requirement for employers

For years, activists against illegal immigration pushed cities across California to adopt ordinances ordering businesses to verify that their employees were eligible to work in the U.S.

But those victories appear to have been wiped out this month with legislation signed into law that prohibits the state, cities and counties from mandating that private employers use E-Verify.

Those who sought the state law in reaction to the growing number of localities adopting mandatory E-Verify rules said such moves were a distraction from a larger problem.

"As a nation, we are in such desperate need of immigration reform," said Sara Sadhwani, strategy director for the California Immigrant Policy Center. "While a handful of cities in California and a handful of states across the country have moved to mandate the use of this kind of program, it's very misguided."

The state ban received broad support, including the California Chamber of Commerce and the California Farm Bureau Federation, which questioned the accuracy of the databases used by the federal system.

Assemblyman Paul Fong (D-Sunnyvale), who introduced the bill, said he felt that mandatory E-Verify was an unnecessary burden on businesses.

So the reasoning is that efforts aimed at suppressing illegal immigration are a "distraction" from the effort to legalize illegals through "immigration reform."

But wait - don’t the amnesty and illegal alien lovers and the ACLU say that immigration is a federal responsibility?

Shouldn’t they be suing California for passing immigration laws?

The state can't mandate it, but it doesn't say the private employer is banned from using it. The private employer is still prohibited by law from hiring illegal aliens. It is in their best interest to do the E-Verify to cover their own backsides.

The Chamber of Commerce, putting America last before greed. In this regard I agree with the protestors. The Chamber of Commerce and the Wall Street Journal don't give a damn about real America and average folks.

When America becomes a Third World country in 20 years, let's see what the Chamber of Commerce does when the country is controlled by the Democrats and their La Raza allies.

Ok - so let everyone in - have them take all the jobs for cheaper pay - soak the whites who haven’t yet bailed - yeah, that’ll work. The democrats will be permanently in charge of the bankrupt country. This must be what they want, right? The “fundamental transformation” of the USA will be complete.

Rick Perry should be applauding California and Jerry Brown. Perry opposed the use of E-Verify in Texas.

I am an employer in California. I am an employer in the ag industry. E-Verify has not been a problem in fact it has made the process simpler.

The conversation in the comments to the article has Mexicans crowing about AZTLAN coming soon and taking over California and responders saying you can have California, it will be a garbage dump by then anyway.

This wasn't appropriate and, besides, it's another lie about Perry.

Perry opposed mandating E-Verify at the state level. Brown's banned municipalities from mandating its use even at the local level.

Surely you can tell the difference in the policy positions.

You and too many others play fast and loose with the facts to tear down a candidate you don't like. I see it with Perry, I see it with Cain. It's not necessary and not helpful to anyone.

This needs an initiative but I doubt we'll see one.

There's no reason for a state to ban local governments from requiring e-Verify.
