Arizona state senator recall election can go forward, judge rules

An Arizona judge ruled Friday that a special election to recall state Senate President Russell Pearce, the primary sponsor behind a controversial anti-illegal immigration law that a federal court struck down in April, can be held November 8 as planned.

In an 11-page ruling, Maricopa County Superior Court Judge Hugh E. Hegyi rejected nearly all of the arguments alleging problems with the recall petition.

The suit was filed by Franklin Bruce Ross, who backs Pearce and who alleged problems in the way the recall petitions were filled out. The suit cited as an example the language in the oath sworn by the circulators of the recall petitions did not state that the signatures collected were "genuine" or the "functional equivalent."

But Hegyi concluded that the legislation concerning recall elections does not mandate that the oath contain the word "genuine." "It merely requires 'an' oath that the Petition signatures are genuine, but does not prescribe a specific oath that will accomplish that objective," the judge wrote.

In this case, the requirements of the law -- which he described as constitutional -- have been met, he said.

"Obviously, I'm pleased," said Thomas Ryan of Chandler, Arizona, a lawyer who represented the petition-drive organizers Citizens for a Better Arizona. "It's a big victory for the 10,000-plus people who signed that recall petition to get rid of their senator."

Essentially the same tactics used against Sarah Palin after she returned from the 2008 campaign. Substitute the word "Ethics" for these recalls.

Recalls are a valuable tool to remove truly corrupt politicians and biased judges, but are a two-edged sword.

Fighting recall is a very expensive thing, one that many polliticians cannot afford. It is usually less expensive to initiate a recall than to defend against, and in many cases is nothing but harassment. Wish there were some way to enforce "loser pays" on this.

The majority of them. This whole fiasco is about the Mexican Nationals, who are in this country illegally, using political correctness and our corrupt courts and judges to stick it to the gringos.

Leave it to the party of slavery, Jim Crow, segregation, solidarity with mass murderers, et.al., to abuse the recall process by using it at as a battering ram against those who stand up for liberty and common decency.

Just another day in the street theater agit-prop melee that the left has turned the political process into.

If the recall looses, the group that sponsors it must pay treble all the cost by the government and the victim. That would slow it down.

Typical CNN half right story. As I remember, the law wasn’t struck down in total by a federal court and is in fact being appealed to the US Supreme Court. So the impression CNN is trying to leave is that the law was struck down in finality is false — typical of a leftist news organization

There is an ominous story behind the scenes of these recalls.

Republicans, more so conservatives, need to understand the raw power and resources behind these recalls less they find out too late. Unions and allied groups of the Big Government welfare state, like La Raza and the SEIU and Soros, have and will apply unlimited resources against office holders they oppose.

You saw the $30 million warchest against state senators in Wisconsin. Pearce will find himself up against $ millions from these same groups, who have learned how to concentrate their resources into certain key battles, where a victory can be used as a token far more significant than the small local office involved.

Do not underestimate how effective these tactics are. You do so at your peril. And they are coming to your town and state soon.

I once believed the ability to recall an elected official
was a good idea. Now that I've seen it in use I've got to admit I was wrong. Anyone can word a petition in such a way as to get people who would normally support a person to sign a petition calling for their removal.
This along with controlling the Secretaries of State or other offices certifying elections at the state level is the new modus operandi for the dems who can't win at the ballot box.
Recalls should only be for lifetime positions such as judges and not for those elected to terms of office.

We should do the same thing to them. Recall election rules are probably somewhat different, depending on the state I would guess.
