Can Prison Officials Forcibly Medicate Jared Lee Loughner?

Arizona shooter Jared Lee Loughner was declared unfit to stand trial last month, a ruling that put government prosecutors in a position of having to try to restore Loughner to a mental state that would allow him to defend himself in court.

Prison officials is Missouri, where Loughner currently is undergoing a mental evaluation, decided earlier this month to try to medicate Loughner against his will with anti-psychotic drugs.

But lawyers representing Loughner have asked a federal judge to block prison officials from forcibly medicating Loughner, WSJ reports.

U.S. District Judge Larry Burns is considering the issue at a hearing today and may decide on the spot whether Loughner can be involuntarily medicated.

Either way he’ll never see the light of day - you can count on that. His mistake was shooting a democrat. Had he shot a republican he’d make a remarkable recovery in a few decades and be ready to go live with his parents. See Hinckley, John.

The clincher is his violent behaviour toward others. At that point, any argument he has flies out the window.

Shouldn’t take this long. I don’t want to oversimplify this, but did he or did he not pull the trigger? Yes he did. There are plenty of eye witnesses to that fact. Was he justified in doing so? Absolutely not. He could be Perry Mason himself and he couldn’t fast talk his way out of this. This case is as simple as simple gets. Hang him already.

This happens all of the time in psychiatric hospitalas across the country. The primary difference is that they don’t wait months—perhaps days—in order to go before a judge and treat the patient.

Why lawyers would attempt to block this I’m unsure, other than to attempt to have their client appear completely out of it if he should be in court.

His lawyers were the ones who argued he was too insane to stand trial. The judge’s reponse was. let’s get him medicated and see how insane he is. It appears the defense team is already in charge of this courtroom and trial, a bad sign but not unusual.

Next thing you know the courts are going to rule that in addition to a mind like a steel trap, a defendant needs a law degree to defend himself, and that taxpayers have to pay his law school expenses while he’s getting it.

I worked for a law firm that represented Thomas Sell in a similar type of forced medication case that was decided by the Supreme Court in 2003.
