Homeland Security Secretary Janet Napolitano on Monday acknowledged a storm of criticism from lawmakers and immigration-rights supporters over a federal effort targeting criminal immigrants, saying there has been confusion over whether local communities can choose not to participate in the program known as Secure Communities.
But she added that local governments cannot decide on their own to "exclude themselves" from its fingerprint-checking database.
"This whole opt-in, opt-out thing was a misunderstanding from the get-go ... and we have tried to correct that," Napolitano said during a visit to The Chronicle's editorial board. She said communications from the Department of Homeland Security's Immigration and Customs Enforcement division - known as ICE - were "subject to misinterpretation."

So the liberals consider Arizona evil because it does not follow the federal dictates (at least to them) on immigration law but their communities are immune from federal immigration law. Go figure.

States and local communities can pass laws on illegal immigrants, anchor babies, taking away benefits to illegals, defunding sanctuary cities etc. and there isn’t a damn thing the feds can do about it especially when these things are done within many states at the same time or simultaneously. The feds just do not have enough money to sue everybody.
This woman is a total disaster. No one believes a single word coming out of her mouth. It is like she doesn’t think that people literally see what is actually happening on the border. What a typical mindless bureaucrat.

A bill to let California communities opt out of a federal government program that checks the immigration status of arrestees has been approved by the Assembly’s public safety committee.
The committee voted Tuesday to advance debate on whether to have local communities decide if they want to participate in the so-called Secure Communities program.
The proposal by Democratic Assemblyman Tom Ammiano is supported by immigrant advocates and San Francisco Sheriff Michael Hennessey who say immigrants shouldn’t fear getting deported when they report crime.
The state sheriffs’ association opposes the bill, citing the cost savings of a program that automatically checks arrestees’ immigration status.
Some California communities have wanted to opt out of the Immigration and Customs Enforcement program but have been unable to because it is not voluntary.

“Napolitano was also asked about the Secret Service’s request to The Chronicle for permission to monitor phone traffic to the newspaper’s headquarters. The request was denied, said David Byers, the newspaper’s director of facilities and real estate.
Napolitano was asked if the request was part of a new protocol in her agency. “I don’t know the answer,” she said, adding that she would look into the matter and get back to the paper.
The Secret Service released this statement on Tuesday:
“A request for a caller ID device referred to as a ‘phone trap’ is standard operating procedure for sites visited by protectees of the Secret Service in San Francisco in order to quickly identify phone numbers should they call in a bomb threat or other type of threat to a protected site. There is no monitoring of phone conversations nor are there any lists of phone numbers generated.” [end excerpt]
