Calif. seeks right to sue over greenhouse gases

California and five other states are urging the U.S. Supreme Court to let them sue power companies whose plants emit greenhouse gases, saying legal action is needed as a backup for the Obama administration's embattled efforts to curb pollution that contributes to global warming.

The case, to be argued April 19, pits the states and environmental organizations against an unusual alliance: the energy industry, which opposes the emissions limits, and the Obama administration, which says such restrictions should be imposed by Congress and federal agencies, not the courts.

The Environmental Protection Agency plans to issue regulations in May 2012 that would limit emissions of carbon dioxide and other greenhouse gases from the coal-burning plants that are the targets of the states' lawsuit.

But House Republicans are backing legislation, due for a committee vote today, that would eliminate EPA authority over greenhouse gases and repeal California's controls on carbon emissions from cars and trucks. The bill would allow the federal government to restrict tailpipe emissions but would leave greenhouse gases from power plants unregulated.

The six states - California, New York, Connecticut, Iowa, Rhode Island and Vermont, along with New York City - want the Supreme Court to uphold their right to sue five major power companies and then return the case to a federal judge in New York.

California and the other states are seeking court orders requiring the power companies to reduce carbon emissions by 3 percent a year for 10 years.

The companies operate 174 plants in 20 states. None is in California, but the suit says they produce 2.5 percent of the world's emissions, thereby warming the planet and melting the Sierra snowpack earlier. That affects the state's drinking water supply, the suit says.

California already imports more electricity from other states than any other state and they want to sue their own power companies?

The problem with dumb is that telling them they are dumb does no good because they are too dumb to understand that they are dumb.

The power companies need to shut down and walk away from these idiots. Then the state can explain to the residents why there is no electricity and they now have to light their own farts for heat and light.

It’s good that I don’t wish to have my account suspended or my comments deleted, because I’m afraid that the first comment that comes to mind includes a profanity in regard to liberal Californians. As it is, they are reaping what they’ve sewn. [Unfortunately, a lot who are not liberal are reaping it as well.]

I wonder if the liberals find themselves in a moral dilemma over this. On one hand they are convinced that carbon footprint and greenhouse gasses are critical to the survival of the planet. On the other hand, you need a lot of power and a big carbon footprint for that huge indoor marijuana grow in your basement.

They know that power companies won't be paying the bill. If CA would just
outlaw power completely there would be less pollution, they should set an example.

They want to be allowed to sue over this non-scientifically-proven issue, but heaven forbid anyone should be allowed to sue to prevent illegal immigration. Doesn’t this sort of selective enforcement of legalities violate some kind of equal protection clause of the U.S. Constitution?

California needs to shut up or build their own power plants and quit complaining.

How did Californication become so awfully whiny and nuts?

Seems to me - if California were to sue a power company for “greenhouse gasses” being emitted” - then that power company would be well within its rights to turn off the juice being provided to that OBAMination of a state. Let the suckers in the southern part of the state sweat without A/C, and those in the northern section freeze in the cold (cause the lefties sure don’t want folks burning stuff to keep warm...).

I think after they sue their own energy providers out of business, they should be granted privilege to sue out of state providers out of business too.

Then outlaw candles and fire.

There is one thing KNOWN about that ‘pollutant’ carbon dioxide.

ALL LIVING THINGS are made from carbon dioxide! Even non-living things like limestone are made from carbon dioxide.

So, we should be just a little careful eliminating the basis of all life, don’t ya think?
