Montana Bill to Require Candidates for Federal Office to Submit Birth Certificate

Montana State Representative Bob Wagner (R-Madison County) has introduced HB 205. It requires candidates for President and Congress to submit a birth certificate or other proof of birth, when they file paperwork to appear on either a primary ballot, or a general election ballot, or even to file as a declared write-in candidate. The only loophole in the bill, for presidential candidates, is that someone who didn’t run in a presidential primary in Montana, but who is nominated by a ballot-qualified party, need not file the documents to appear on the ballot in November.

Members of Congress need not have been born in the United States, so the ostensible purpose of applying this bill to congressional candidates is to satisfy the U.S. Constitution’s requirements as to age. Members of the U.S. House must be 25; U.S. Senators must be 30. Thanks to Bill Van Allen for this news.

Every time the paperwork connected with filing for office is made more complicated, chances increase that something will go wrong, and otherwise qualified candidates will be disqualified for inadvertent errors.

The elites back east will throw everything they’ve got at this, including the kitchen sink.

They’ll try to get it declared “unconsitutional,” irony notwithstanding.

Notice how Jared Loughner has been swept off the stage and deposited in the dumpster back behind the theater.

I think more states should get on board. Nothing for anybody to be ashamed about- it’s just a means of better enforcing the requirements of the Constitution.

YES!!

If they want to take a job working for the citizens they must present their credentials.

People cannot legally take a job flipping burgers without proof of citizenship, why should politicians be above the law?

Make them complete an I9 form too.

Might as well not even bother to file the bill. Zero's henchmen will claim that the "birth certificate" he published is proof and that will end it. It should be specific - A REAL, ORIGINAL B.C. or nothing. I've got mine, tattered, yellow, but original, in my gun safe. And I can tell you EXACTLY where I was born. The hospital is still there.

Yeah, it sounds like this bill needs to specify the BC and to be re-worded.

Well, I suppose at this stage, it couldn’t hurt to send emails, faxes, etc.- who knows, maybe it can be changed?

Yeah, it sounds like they’re trying to dance around POTUS’ eligibility issue. I’m guessing this bill would be worthless if he isn’t primaried.

Why the loop hole? It seems like the loop hole will allow someone, even born in Indonesia or Kenya - to be on the ballot. So, what’s the point?

Trust me if any state passed a law requiring the Presidential Candidate to show proof of citizenship the proverbial s _ _ t would hit the fan.

I’m not sure. I don’t know if the supposed “loophole” is merely an election law attorney’s (maybe a Democrat?) interpretation of ambiguous drafting, or the article author’s view, or if that’s really the case.

It does seems like a waste of time though if it really is the case, because they’re back to relying on party officials certifying things again. But hopefully, more states will ponder taking action on this matter- with laws that will have teeth.
