Feds confirm fifth man in custody in border agent's killing

A fifth man is in custody in connection with the Dec. 14 fatal shooting of a Border Patrol agent Brian Terry near Nogales, the U.S. Marshals office has confirmed.

Newscast last night said the FBI has had him in custody since the day after the shooting.

He'll probably have to stand in line for at least 10 minutes at the voter's registration office prior to being released.

TUCSON, Ariz. (KGUN9-TV) - Three weeks ago tonight, border patrol agent Brian Terry was shot 19-miles north of the border. He died of his wound early the following morning.

And, while time has ticked on, little has changed for the Terrys since Brian’s funeral except for getting more and more ticked off.

“We’re still just all about where we were just like three weeks ago. And, I think one of the most difficult things is no one is giving us any answers or what’s happened to Brian,” said step mom Carolyn Terry.

An autopsy, for starters; that’s one thing the Terrys are asking for. They want to know exactly how Brian died. At first, they were told it was from an ak-47 bullet through his side. But, now they’re questioning that, and so many other rumors they say they keep reading about on the Internet.

“Right now, what are you most upset about? Asked KGUN9. “How my son died? Was he shot? Was he shot by friendly fire? Why is the border patrol all of a sudden… they cant talk?” asked dad Kent Terry.

They’re all questions KGUN9 has also worked hard to try to get answers to; but, like the Terrys we also came up empty. Border patrol and the Department of Homeland Security (DHS) sent us to the FBI, the agency handling the investigation. They handled us by simply saying the FBI’s “level of secrecy is standard for an ongoing investigation”.

But, the more silence, the louder agent terry’s father vows he will be, taking direct aim at President Obama, “My son died. His blood is on that dirt, not his (President Obama) and the longer this goes on and the more I don’t hear, the madder (sic) I’m going to get and the more I’m going to start talking,” vowed Kent Terry.

Irking Kent Terry even more? None of the four suspects in custody are charged with any crimes, besides re-entering the United States unlawfully. And this is what one of their lawyers told KGUN9 last Thursday. “I have not seen or heard anything that actually links him to anything more serious then him being here without documents,” said Leslie Bowman, attorney for one of the four suspects in custody.

On the day of Brian’s funeral, the Terrys say border patrol told the family they had the man responsible for their son and brother’s death, “He stood right there (a border patrol agent) and told us one of the Mexicans we have is the shooter. He was happy about it. And, now we’re hearing this we’re going to send them all back,” said Carolyn Terry.

“Sending them all back” is another Terry family concern. A public defender on the case told KGUN9 last week if the feds have solid evidence against any of the four suspects in custody, it’ll have to submit its case by January 15th. Otherwise, there’s always a slight chance they could get deported back to their native country.
