Is it actually illegal to take or have in one’s possession a prescription drug, that is not your prescription?

Indiana already monitors all Schedule II medication prescriptions to stop the practice of “doctor shopping”.

This while cheap heroin and meth flow over our southern border.

I’m not sure if this law has done anything to stop prescription drug abuse, but I think it is a major violation of a persons privacy rights. Every day we are moving closer to a full blown police state.

Computers have made some improvements to life but have opened up a whole host of ways for government to abuse your rights.

If a court - any court - allows this, you might as well just walk the Constitution out of the Library of Congress and set it ablaze.

To think that someone who alleges to defend the Constitution and civil rights would even suggest this, is well beyond the pale.

"Is it actually illegal to take or have in one’s possession a prescription drug, that is not your prescription?"

It depends on the jurisdiction, but if it's a Schedule III drug, in most jurisdiction - all that I am familiar with - it is illegal - usually a stock "possession" charge, which may be a misdemeanor or felony depending entirely on how many pills you're holding.

Why do people with fascist instincts always gravitate to positions of power over other humans?

This is about arresting normal, innocent people based on what’s on their shelves. The criminals who obtain the stuff illegally will go free, as they always do, while the innocent people help the law “enforcement” people get good numbers

Funny how some issues bring out the exact same reaction from both the left and the right. Just saw the same article over at DU(shower time). You would think DU was full of freepers.

I should add that it doesn’t necessarily have to be a Schedule III drug, or even a prescription drug. In MANY jurisdictions, some OTC medications - like Pseudoephedrine (sp?) are limited to the quantity anyone one person may have in their possession.

What are they going to do, submit a list of everyone in the state?

Back in the early eighties at an industry meeting a speaker noted that there would be some huge number of computers in use in 20 years.

A heckler stood up and said wadda you going to do, put one in every door knob???

Been in a hotel lately?

What about buying drugs or having in your possession, drugs for someone that is incapable of doing it themselves?

As it stands now, doctors and pharmacists are the main users. Who are the other users?

I would think the insurance co's would have everything the sheriffs hearts could desire and more. Obamacare will likely give access to all legal and medically proper drug use. Quite a law enforcement tool. Can you say "police state"?

"HIPPA"

There is a GAPING hole in HIPAA that allows for disclosure of Patient Health Information (frequently seen as PHI), to be disclosed to law enforcement in a number of instances, with one being...

Pursuant to legal process and as otherwise required by law;

It's known as the "law enforcement exception". HIPAA does much more to inhibit the dissemination of PHI by private parties, than it limits the government's ability to take a peak at your health records, vis-a-vis law enforcement.

Generally, such disclosure must be ordered by a court, but there are other circumstances where a warrant can be unnecessary, like if a state law requires that all Schedule III drug prescriptions be reported.

Welcome to the police state.
