ALBANY -- The state Education Department this week issued guidelines to school districts on avoiding questions that could disclose a student's immigration status.

That means inquiring about citizenship status, Social Security numbers and similar information are out of bounds when a student enrolls for school.

The guidelines issued Monday were a response to a New York Civil Liberties Union study that found 139 of the state's 694 districts intentionally or unintentionally asked about citizenship status. Fourteen Capital Region districts were cited in the NYCLU study.

Jonathan Burman, a department spokesman, said Tuesday the guidelines will help districts make sure their policies comply fully with the law.

The student registration guidance memo says that districts should not ask about a child's immigration status as it "might chill or discourage undocumented students from receiving a free public education."

When will there be guidance to not ask if someone has guns, or, if the fact they have guns is undeniable, to not ask whether the guns are “documented” or not?

It would appear so...

This is another case of ACLU intimidation answered with spineless bureaucrat surrender... The bureaucrats have no skin in the game and are all too willing to cede the ethical and moral authority of those they supposedly represent -the people as well as open the peoples pocket book to fund leftist ideology ...

I do not know there is a simple answer to counter this long ongoing progressive onslaught upon individual freedom premised in civil rights... It is a battle on a legal battleground and maybe that is where there should be a focus. Those with perceived civil rights violations have standing in courts and seem to have an upper hand over the citizens held hostage funding their ACLU created rights and liberties. The citizens that have to pick up the tab in cases such as this seem to have no standing...

In this case, I guess as long as New York taxpayers pick up the meal tab the ACLU will continue adding menu items to the progressive buffet...

Is every politician in NY an escapee from an asylum?

The State is verging on bankruptcy, like CA, but they want to continue to provide free benefits to illegal aliens!

I think it would be appropriate for other States to arrest their illegals and send them to CA and NYC. Those are the two States that have mainly driven the progressive movement toward Marxism/Socialism anyway, so let them practise it more fully ....and fail, with NO bailouts!

Yes. I would suspect it is more a case of change at the local level being 'allowed' rather than being created as we saw evidenced with the "139 of the state's 694 districts intentionally or unintentionally asked about citizenship status". Those 139 districts had the right idea and were being fiscally responsible to the citizens in their districts. They would have

At its root I would say that the problems are a result of subsidiarity and self-determination being taken away as a result of centralized power -big government is the problem...
