According to the complaint, Haecker says other maintenance workers excluded him from department meetings and intentionally spoke Spanish around him in retaliation for complaints he had made about them playing poker and looking at pornography when they should have been working.

The suit states that Haecker complained about the illegal conduct and “reported his coworkers’ failure to work, playing poker and other card games, gambling on the job, looking at pornography, sexually harassing women, and not completing their assigned tasks.”

After he complained, the suit alleges, his co-workers would not speak to him: “He was chagrined and shunned.”

The suit states that after Haecker complained, Holston reduced his work hours from 39 to 24. He also alleges that he overheard either Holston or a senior parks maintenance worker saying, "We're not going to hire any more old guys."

Jailed for speaking her mind

It "was a little past 11 a.m. on an August day in 1998 when Janice Barton, 45, was leaving the Peppermill Restaurant in the Lake Michigan shoreline community of Manistee, with her mother and daughter," reported Michael G. Walsh of the Muskegon Chronicle, back in August 2000. "As Barton and her family tried to make their way through the crowd, a man -- in Spanish -- asked his wife to make room for them."

According to witnesses, Barton, who does not understand Spanish, told her mother: "I wish these damned sp!#@ would learn to speak English".

Carol Benitez, one of the Spanish speakers and an off-duty Manistee County sheriff's deputy, followed Barton outside and copied down her license plate number.

Almost two weeks later, Barton was charged with disturbing the peace. But when she appeared in court Oct. 13, 1998, the charge against Barton was changed to "insulting conduct in a public place" under a city ordinance -- similar to ordinances now widespread in the area -- which simply declares, "No person shall engage in any indecent, insulting, immoral or obscene conduct in any public place."

In court that December, Barton testified that she believes immigrants should speak English when in the United States. But the jury agreed with the judge that Barton's words were "fighting words" -- not the kind of speech protected by the First Amendment -- and convicted her of the misdemeanor.

Judge Brent Danielson initially sent her to jail for 45 days, but eventually released her after only four. Judge Danielson said: "This isn't just some generalized stupid speech where someone is just engaging in fascist xenophobic logorrhea. This is directed at someone. It's -- you don't say words like this when someone is present, like this, unless you are either intending to hurt them, to injure them, or you are intending to engage in some kind of a physical altercation. This is a restriction on a free speech that's especially to be guarded in Michigan."

This guy should claim mental distress and apply for State Disability and make all those Spanish speaking gov't workers pay him for doing nothing. It's time the white male receive reparations for the damage the Civil Rights Act has caused them. And no I'm not kidding. It's THAT bad. I witness this on a daily basis. When employers feel like dishing out some crap, white males take the brunt of it because employers know there isn't an attorney or judge in the land that will defend them.

The Civil Rights Act has turned white males into whipping boys for employers AND female and other minority workers to indulge themselves in.

This isn’t new. When I completed a 2 year communications program at a local community college in 1974, the last weeks were devoted to job searches. Our very diverse class was told, in no uncertain terms, that white males were “over-represented in the Bay Area and were un-hireable.” The reps from the local network affiliates said that they’d instantly hire minority females, even with 2.0 GPAs, since they could fill several quota slots that way.

When I pointed out that this was nothing more than blatant discrimination, I was told that it was “affirmative action,” and furthermore, I should be “proud to be among the first to right historic wrongs.”

It didn’t matter that I’d been supporting myself since I was 16, when my parents suffered a very nasty, alcohol-fueled divorce. It didn’t matter that I was also working full time while trying to get a college education, and that I had a 3.75 GPA. I had the wrong skin color and gender, so I couldn’t get a broadcast job locally.

And today? If you’re not English and Spanish bilingual, forget getting a retail job in California.

This madness has to stop.
