Is Life for Rubashkin Overkill?
inn ^ | 6/23/10 | Edwin Black

Originally, some people said they wouldn’t mind if kosher butcher Sholom Rubashkin got life in prison and rot behind bars until he dies. Yesterday, June 22, 2010, their wish was fulfilled by U.S. District Chief Judge Linda Reade in a northern Iowa courtroom. Under the stiff sentence, Rubashkin rots in jail essentially until he dies, a 27 year sentence supplemented by five years of probation to the 51-year man—and then he pays $27 million in restitution. Judge Reade’s sentence exceeded even the government’s request of 25 years. Now many people are outraged at the harsh treatment being meted out to Rubashkin and ask in disbelief, “What's going on?”

Within hours of the sentencing memorandum, issued a day in advance by Judge Reade, legal scholars expressed shock thousands of Chassidim gathered in vituperative video-streamed protests in New York and Los Angeles, and a cadre of agitated appellate attorneys vowed to overrule the judge’s decision.

No one was killed, no one was physically harmed. No one worked in that plant except by their own free will or that of their parents.

Every day millions of Americans employ illegal workers, in landscaping, construction, farming and housekeeping jobs. That’s wrong, but it’s the common thing.

Sholom Rubashkin is being hogtied and buried in prison for life because he is a obvious Orthodox Jew. His crimes are all misdemeanor offenses. That is in the true old school sense of that word ‘misdemeanor’, not the perversions of statute law that now extend ‘felony’ to the trivial.

Sometimes I wonder how meat and vegetables got the the supermarket, hotel rooms got cleaned, lawns got mowed, drywall hung, etc. before the advent of illegal immigrant labor.

The sentence here has nothing to do with hiring illegal immigrants and/or under-aged workers.

The charges in question involve multiple counts of bank fraud and other financial shenanigans. The immigration charges were ultimately dropped because the prosecutors felt the financial crimes would warrant such a serious sentence that the immigration charges would be overkill.

Anna McCarthy testified that she witnessed individuals within the church coaching illegals to complain and testify of severe abuse by rubashkin – so that it will help them remain in the USA legaly and not be deported.

ANA McCARTHY: born in Panama Canal zone, raised in Panama, now a Spanish language translator living in Illinois. Worked for Spanish language TV. Have worked for Mexican consulate and immigration lawyers in the US

“I was just speaking to the people to see what was happening. I wasn’t taping the people. Someone else was taping. went to St. Bridget’s Catholic Church August 21

“spoke to people who said they were former Agripros employees in the rectory. Met Thomas Wash who was meeting with a couple. There was another couple waiting, and I was waiting.”

“U-visas are almost impossible to obtain”

F MONTGOMERY BROWN (defense): if illegal alien found in the US with 3 months of their 18th birthday … have you worked with immigration lawyers re: people seeking residency?

ANA McCARTHY: “yes, including U-visas.

“I was gathering information in order to get an opinion to tell the news networks.”

(going over Thomas Walsh and Jewish Council of Urban affairs working with St. Bridget’s Church. )

“Walsh was having discussions with people about visa issues. He told them if they made claims, they could get legal status in the US.

“I was there to meet with Father Paul and Sister Bradly. I waited by a couple and was talking to them. We could hear what Walsh was saying. He was coaching them, telling them about the rights, what they could do to get legal state. He said they had to say they were being abused by Mr. Rubashkin. told them he was a filthy Jew who became rich at their expense. telling them they could get deported.

“Walsh got upset when he came out and saw me, Father and Sister did nothing. Walsh almost assaulted me. I tried to reach Jewish Council for Urban affairs.

Local residents support immigration reform rally in Postville

http://www.decorahnewspapers.com/main.asp?SectionID=2&SubSectionID=10&ArticleID=18041

"This is a call for justice," said Sr. Mary McCauley of St. Bridget's Catholic Church in Postville and one of the march's organizers. Emphasizing the need for reform, not raids, Sr. McCauley said "[the raid] has had devastating effects on the community, separating families and hampering an ongoing investigation into labor violations at the plant... This is a call to be faithful to our American and religious values. This is a call to stand in solidarity with our Hispanic brothers and sisters." “I complained to Catholic church, referred to Sister Bradly…”

Posted earlier---stephenjohnbanker predicted: “ I read all about this case. The owners are criminals, and they will do serious time.”

Man, they did every crime in the book.......... and then some. They got great PR when they landed in Iowa----including whining articles on problems "fitting in" to conservative Iowa culture. I guess wise Iowa conservatives were onto the scams from the getgo.

BTW, the Rubashkins are related to NYC Rabbi Balkany who ripped off the US govt (taxpayers) of millions of dollars---and never served a day in jail. Balkany got tax dollars to build a "secular" daycare center attached to his synagogue----execept that no one but Orthodox religious were admitted (if at all). It was one big scam. Balkany is also close to Sen Joe Lieberman (I-Conn).

=======================================

ITEM US Sen Menendez (D-NJ) is facilitating voter fraud and the establishment of Mexican drug labs on US soil. Violent drug cartels are pouring over the border. Illegals undermine US ntl security with fake documents.

One wonders if Menendez is being paid to make the case for mollycoddling illegals. L/E should investigate Menendez's statements and examine his campaign donations.

ITEM Raids at meat-packing plants across America found workers were illegal aliens using stolen or forged documents. One plant even had a working meth lab. How convenient...and lucrative.... for the drug cartels.

Meat-packing companies claimed they didn't know the people they hired were illegal; that‘s when our govt came up with E-verify program.

Menendez opposes the e-Verify program. Menendez has a bill to stop these raids, claiming they "violate the rights of Americans of Hispanic descent" who can't produce a birth certificate or other documents to prove who they are.

Most Americans are required to prove to state govt they are legal Americans just to renew driver's licenses---or to get a passport----by coming up with several pieces of ID to prove who they are; some Americans have to pay to get new docs and make long trips to get the required docs. But Sen Menendez doesn't worry about OUR rights.

QUESTION Where do Menendez’ loyalties lie? When Menendez was under fire for using his elected office to get taxpayer money for a facility he owned and rented out, Menendez took refuge in the Dominican Republic, giving news interviews in Spanish. (Probably also visited his tax-free bank accounts).

QUESTION Where does Menendez get campaign funds? If Menendez is a paid agent of a foreign government, he should be subjected to US laws.

CONFLICT OF INTEREST ANYONE? Menendez is also connected to a lucrative lobbying group run by his girlfriend (a former aide he divorced his wife for). Menendez' lobbying group could easily facilitate sub rosa payments from foreign governments.

ITEM Sen “Reconquista Menendez opposes the e-Verify program. Menendez has a bill to stop these raids, claiming they “violate the rights of Americans of Hispanic descent” who can’t produce a birth certificate or other documents to prove who they are. “ If they are indeed Americans of Hispanic descent, they can easily prove it.

ITEM Mexican military officials running drugs across the border repeatedly into the US is also a matter to be looked into.

=============================================

REFERENCE Agriprocessors produced Kosher meat and poultry in Iowa. It was founded by Brooklyn butcher Aaron Rubashkin, and managed by his son Sholom. In the affidavit filed as part of the 60-page application for a search warrant of the premises, details were revealed of the government's investigation including numerous allegations of health and safety violations, mistreating workers, and using controversial slaughter practices.

A former supervisor at the plant --identified as Source #1- told investigators that some 80% of the workforce was illegal. The source also said he believed rabbis responsible for Kosher supervision entered the United States from Canada without proper immigration documents. The rabbis are believed to be Israelis.

Sources related stories of fraudulent documents and Social Security numbers presented for employment. Several said they were aware of undocumented workers paid by supervisors in cash. The affidavit says the government has probable cause to believe that an Agriprocessors supervisor assisted workers in acquiring fake documents in exchange for a cut of the proceeds.

ITEM The Des Moines Register headlined that methamphetamine (AKA crystal meth) was discovered in active production at Agriprocessors (a substance that has been linked to Israeli suppliers).

In another notorious case, Rubashkin apparently "sold" $2 million worth of meat to Allou Healthcare (a company controlled by the Rubashkin's Hasidim brethren) Only problem is, Allou distributes health and beauty items------and is not in the food business. Authorities might consider that Allou paying Rubashkin for a product it did not sell might be a kickback, money laundering or tax evasion scheme.

Money laundering or tax evasion might be integrated into these bank fraud schemes----diverting millions of dollars in customer payments that were part of First Bank’s collateral and instructing an Agriprocessor employee to delete evidence of the scheme from the company’s computers........for which Rubashkin was arrested and charged with bank fraud.

Since he was convicted, this no longer involves CLAIMED fraud, right?

Are you suggesting that bank fraud isn't a serious crime?

His crimes are all misdemeanor offenses. That is in the true old school sense of that word ‘misdemeanor’, not the perversions of statute law that now extend ‘felony’ to the trivial.

He was convicted of lying to banks, causing them $27 million in losses. That was a felony at common law, and the 27-year sentence is well within the federal sentencing guidelines.

The merchandise might be different, but the game looks a lot the same. Some idiot finds out that by bandying around the name of God he can get a lot of undiscerning fools to give him a pass, and his conduct becomes progressively more unethical and outrageous.

Oh, did he defraud the bank or did the Federal Gestapo’s raid shutting down his business cause him to not be able to make payments that otherwise he would have made?

If the secret was Mexicans, then Mexico would be a much better place.

If the secret was Mexicans, then Mexico would be a much better place.

Enforcing our immigration and employment laws would be the best long term growth plan Mexico ever had. How many hardworking and ambitious people risked all to have a shot at a better life. Granted many a low life came over to ride the uncle easy gravy train, but many, if not most came to work. Mexico has encouraged it's labor base to leave the country because the hopelessly corrupt oligarchy is more afraid of them than the drug lords their in bed with.
