Prosecutor to appeal firing after speaking at tea party rallies

LIVE OAK — Even the state attorney who fired her calls KrisAnne Hall a first-rate prosecutor, but espousing her "originalist" views of the U.S. Constitution at tea party rallies has sparked a federal court showdown.

The issue: free speech vs. state employment.

"She can go and speak anywhere she wants to, and do anything within the law, but she can't do it while carrying my badge, not when people identify her with this office," said State Attorney Robert "Skip" Jarvis.

Hall, an Army veteran who handled felonies in Hamilton County until last Monday, walked away from a $55,000-a-year job rather than be silenced. In a terse e-mail exchange, Jarvis told her his order was non-negotiable, but she countered that she was speaking on her own time and dime.

"I speak from an originalist perspective," Hall said in an interview. "The most appropriate way to interpret the Constitution is to look at the original framers' intent. Originalism is on the other end of the spectrum from the Constitution being a 'living, breathing' document."

Has she got a good shot at a suit for wrongful termination/civil rights violation? I don’t think prosecutors have a contract that says they can’t do this, like cops have.

She didn’t libel, slander, or cause a breach of peace.

I believe he's wrong. I think she can speak on anything so long as she isn't wearing the badge or any uniform that goes with it.

As an American she's allowed to be part of the political process. If this prosecuting attorney wants everyone to believe that lawyers for the state aren't involved in politics, then he's nuts. Everyone knows they are.

Yep, which includes running for political office. Her boss has helped publicize her name and her views, now she should take advantage of the situation and run for Congress.
