Questions surround Kagan's handling of White House eco-terrorist controversy

n 1995 and 1996, future Supreme Court nominee Elena Kagan was involved in a bizarre controversy in which the Clinton White House was accused of siding with an eco-terrorist group locked in a standoff with federal agents deep in the woods of Oregon. The incident led to an investigation by House Republicans, who concluded that a staffer on the White House Council on Environmental Quality tipped off the environmental radicals to impending action by U.S. Forest Service law enforcement agents -- a leak that Forest Service officials believed endangered the lives of their agents on the ground.

Kagan, at the time an associate White House counsel, had no role in leaking the feds' plans to the radicals, but House Committee on Natural Resources investigators concluded she shirked her responsibility by not searching for the source of the leak or pushing for punishment of the leaker.

"Nothing was ever done by Elena Kagan to learn the details about the leaks, or to identify the leaker and ensure that proper punishment occurred," the committee’s 1999 report concluded. In fact, investigators found evidence suggesting that Kagan, in internal White House discussions, defended the alleged leaker.

I have a suggestion.

If the stupid bastards on the “Senate Judiciary Committee” approve THIS loser, why not just cancel ALL future reviews of Presidential Judicial nominees?

If SHE gets approved, they won’t stop anyone.

Dick Morris said on Fox the other night and said he knew Kagan very well from the Clinton administration, he claimed she was moderate on most issues, (I haven’t seen any evidence of that!) but the environment was the one area where Kagan really was a far left radical. He said she was to the left of even Al Gore during the Clinton administration and seemed to think that was the area where she might run into trouble during her confirmation.

Unfortunately, it looks like the most we’re going to get out of the Senate Republicans on this is some sharp questions at the hearing. With no judicial record to examine, Kagan’s beliefs and competence deserve far closer scrutiny than they are likely to get.

Some liberals are actually worried that she will move the court to the right, but I just don’t see that that’s the case. Assuming for the sake of argument that those complaints aren’t just a cynical attempt to downplay the fears of conservatives, I think that proposition is based on an oversimplified view of Stevens’ idiosyncratic judicial philosophy. It’s a mistake to simply label justices as “conservative” or “liberal” - it’s a whole lot more complicated than that.

Why would she care about the forests, logging or the “environment”? She hasn’t been outside her house for any excercise except to occasionally hit a softball.

This is close to misprison of a felony since, according to the article, she did nothing to investigate very serious charges and, indeed, did her best to stop the investigation. Republican senators, especially, are loathe to block judicial nominations on the basis of the judicial philosophy of the nominees. However, they are much quicker to act on issues of basic competence and prior unethical conduct. This is the kind of prior unethical conduct that could stop her nomination, especially when combined with her non-existent judicial background and her less than stellar publishing record.

Did Kagan help endanger the lives of Forest Service agents?

Orrin Hatch thinks he’s obligated to rubber stamp because of the way he stood up for Bork. He had that same hangup when Clinton appointed leftist radicals. But Clinton was more sneaky than Obama.

He’s a TOTAL Ass.

How the intelligent people of Utah keep sending this moron back to Washington again and again totally escapes me.

Like Bennett, he needs to be retired.

And AGAIN, as I have said before, SERIAL POLITICAL OFFICE HOLDERS ARE THE GREATEST THREAT TO OUR REPUBLIC. Hatch has been in there too long anyway.
