Jury convicts Palin e-mail intruder on 2 counts; mistrial declared on ID theft

KNOXVILLE — A federal jury this afternoon convicted Sarah Palin e-mail intruder David C. Kernell of felony destruction of records to hamper a federal investigation and misdemeanor unlawfully obtaining information from a protected computer.

The jury acquitted Kernell, 22, of felony wire fraud.

U.S. District Judge Thomas W. Phillips declared a mistrial on the fourth charge, felony identity theft, after the jurors said they were hopelessly deadlocked.

If the Martha Stewart and Scooter Libby cases are any guide, young Master Kernel will be "going away" for about three years. Also, for a young man like him, a felony conviction for "destruction of records to hamper a fdederal inmvestigation" is a very serious thing because it precludes him from entering many professions, definitely including law.

Felony conviction is not an absolute bar to practicing law. Hit the kid again, harder. Try him on the count that resulted in a mistrial.

As for punishment, I predict a fine, restricted movement ("incarcerate" at home or similar), and community service. I don't object to not locking him up - he's not a threat to others, and I suspect he is sufficiently deterred already.

No doubt he can do the “community service” working for ACORN. Barack can always pardon him—whether he would do so as early as this Christmas (in the traditional pardon-granting period) or wait until after the 2012 election depends on whether he thinks there would be some political harm to himself. Not that he should really care about this kid.

This kid will be in club fed if he does go. My guess it will be a year or less. I think a year in the tank would be just punishment.

Stewart only had to serve five months behind bars plus five months of home confinement.

Stewart's offense, false statements to FBI agents, with no underlying offense to cover up, was a lot less serious than Kernell's attemted destruction of evidence that was undertaken to hide and destroy evidence of an actual crime for which he was convicted and, IIRC, Libby received two or three years plus a $250,000 fine for perjury regarding a non-crime. Thus, my comparison of those two cases to this one is valid

Judge Phillips was nominated by President George W. Bush in 2002, meaning Kernell probably doesn’t have a very friendly sentencing judge.
