Defendant in Palin hacking case won't testify

KNOXVILLE, Tenn. -- The attorney for a former University of Tennessee student charged with hacking Sarah Palin's e-mail says the defendant will not testify in his federal trial in Knoxville.

I don’t think so... it appears that him not testifying keeps his motives (and it being a “prank”) subject to speculation. And the attorney is hoping to capitalize on the speculation... and introduce enough doubt, so as to mitigate any sentence.

This is a smart move by the defense attorney... it doesn’t harm the defendant.

And I’m saying this from the standpoint that I don’t think it was a mere prank and that he should be considered like any big-time hacker and put in jail for a long time and be prevented from using computers again for a couple of decades ... LOL ...

The defense attorney is working for his client, without a doubt... :-)

They should have gone after him with hate crime charges... use the Left’s own tools against them.

He may also know that the fix is in and testifying only makes him look worse.

Kernell's attorney, Wade Davies, said Monday morning that Kernell won't testify and that the defense has rested its case after only putting one witness on the stand Friday, an FBI agent who said Kernell had been emotionally upset.

His excuse was that he was emotionally upset. What does being emotionally upset have to do with researching enough about a person to guess their secret question in an email account? He may as well have plead guilty and begged for leniency. His only hope now is that the jury might be as partisan as he was.

If I was ever put on trial I can't imagine refusing to testify on my own behalf...if I was innocent.That's true regardless of how much my lawyers tells me not to.Guilty people refuse to testify at their trial...not innocent ones.

And yes,I've heard of the 5th Amendment.But if I refuse to testify at my own trial I'd expect the jury to assume that I refuse because I'm guilty.And if I'm a juror and the defendant refuses to testify....GUILTY!

Last week as he was walking away from the courthouse, he snidely remarked to the press that Bristol isn’t his type. I never expected him to testify. It would be judicial suicide to allow him to be questioned by the prosecution. I suspect this is why his attorneys haven’t put him on the morning show circuit ( the Today Show, etc.) as a immature young man who merely pulled a bad “college prank”. He’s a loose cannon.

By his own lights, the defense attorney is right to keep the little s*** off the stand.

The very first question the prosecution would ask him would be aimed straight at his democratic politician daddy. Anybody who thinks for a moment the hacking of Palin’s email was just an “innocent” prank by a dumb kid, is even dumber than the hacker.

I find Kernell’s body language quite telling. I think that his atty. has advised him that, no matter what, it’s not going to turn out well. He really looks despondent in the pictures.

No..., it's a "Constitutional right" and if you don't exercise your rights... you eventually lose those Constitutional rights.

Even innocent people can easily be made to look guilty by how they explain their innocence. It's not always a good idea...

From what I understand, in general, the only reason the defendant should testify is the defense team believes (s)he will be be convicted otherwise. It's a last-ditch attempt to gain credibility for the defense's case.
