Comedian to face Human Rights Tribunal (offended lesbian hecklers)

VANCOUVER — A comedian whose put-downs of a lesbian and her companion in the audience is hoping she doesn’t have the last laugh at a B.C. Human Rights Commission tribunal this week.

Was Guy Earle’s discriminatory verbal assault spurred solely by the woman’s sexual orientation, or was the professional funny man exercising his right to free speech when an audience member wouldn’t settle down?

Earle, who’s been a stand-up comic for more than two decades, was the volunteer master of ceremonies at amateur night at a Vancouver restaurant in May 2007.

Lorna Pardy and her same-sex partner had moved to seats near the stage after the patio closed. Pardy’s lawyer says as they spoke with the waitress they were bombarded by a series of gay slurs courtesy of Earle.

But Earle, who lives in Georgetown, Ont., and has a day job as a physicist, has a different version of events and said his remarks come with the comedy show territory.

“When you heckle me and you’ve been disrespectful through the whole show, I come from the George Carlin school of dealing with a heckler,” he said in an interview. “So yeah, I shoved it down their throat and that’s what you do.”

>>Canadians don’t have a right to free speech, do they?

As a former vancouver resident... Definitely NOT. Only if you hate Bush or if you are anti-American, you have free speech.

Last year the Human Rights Tribunals made the huge mistake of tangling with Mark Steyn.

NOT a good guy to get into a war of words with. They finally admitted defeat and slunk away.

But they’re still picking on people without his financial and authorial resources.

Interestingly, in Canada when a complaint is filed with HRC, the government pays for the legal expenses of the plaintiff. The defendant must pay his own.

The Lenny Bruce approach!

He should! Lenny was also arrested for saying a word that they said was a favorite homosexual practice.

Lenny joked that when he said that word he didn't think about that, he thought of any contemporary chick he knew, or would want to know.... or would love....or would marry.

“I have the right to be offensive,” he said. “Because they didn’t find it funny doesn’t mean they can take me to the human rights tribunal.””

I like this guy’s attitude. Too bad the law apparently *does* allow the hecklers to take him to court. Bad craziness.

Thought only Muslims had 'special rights'. . .and Leftist/Marxists. ..) over and above other Canadien citizens.)

Canada can move on; or regress to a shameful 'rights' sink hole.

And of course, Marxist/fascists are the same world-wide; so we have only to look/see where it all takes us. . .or in our case, how much bigger the sink hole can get.

These people have the 'right' to feel offended. Nothing more.

Citizens of Canada.. .speak up and speak out. (We criticize Muslims for being silent. Where are our voices when these people start knawing on our rights; in the name of the rot of freedom detroying, political correctness.)

It might be helpful if the Human Rights Tribunal specifically listed which groups and individuals may be offended and which may not. As it stands now the tribunal is able to shift its target de jour according to how the political winds are blowing.

But . . . that's the whole idea anyway.

“I have the right to be offensive,”

. . .and they have the right to be/feel. . .offended. What a beautifully balanced concept! (But no. . .they want more. . .)

I may have missed it, but the article did not say what he said ABOUT lesbianism that could be considered "discriminatory". It also did not report if he knew they were lesbians or not, but I guess in Canada that doesn't matter.

So you can't offend anyone, huh? What is stopping Christians from getting mooselimbs to say bad things about Christians, and then take them before the so-called "Human Rights Tribunal"?

I have the latest to some extent on the Canadian television news. The comedian Mr Earle has stayed at his home in Ontario and directed James Millar, his lawyer to appear. Now on a matter of procedure, Mr Millar asked if the question of interference in public entertainment by the Human Rights Commission was proper.

The member of the tribunal who appears to call the shots, ignored the lawyer and proceded with the case, thus refusing to rule on a key question. Millar walked out, the first case he has walked out on in thirty years practice.

So far the case has cost Mr Earle $20,000 and he does not appear to be rich. A fund has been set up for him and I hope to forward a few dollars. On a Canadian website, SDA a lady who claims to be a lesbian, has donated to his fund.

Since the two women are claiming $20,000 in damages (I am informed) one could say "follow the money". If I had been there in the club and two woman were together, it would not matter one whit to me what their sexual orientation was. I presume most of the patrons did not care either- just a noisy twosome who should have been shown the door.

One time my wife and I were shown to a front table near the stage. I had no idea what kind of performances were coming. A gay comedian came out, and started conversing with us as comic material for the crowd. Asked my wife where she was from. "San Francisco". He said "Really? Everyone knows there aren't real women in San Francisco!". We went with it during the next few minutes, and it got funnier and more insane and the crowd was cracking up. My poor wife endured some abuse, but was a good sport.

Later on, one of the gay comedians in full drag came out and sat on my lap, serenading me in front of my wife. We're straight, we could have sued for the straight slurs. But sometimes you have to just laugh and not take things too seriously.

Are there any rational parts of Canada? If so, maybe we can trade for some of our more pinko states.

The member of the tribunal who appears to call the shots, ignored the lawyer

Last September, the B.C. Supreme Court quashed the tribunal’s decision to have a full hearing. The court ruled the tribunal might not have the jurisdiction to determine if Earle’s words were protected expression.

But in January, the tribunal said it would decide if it has jurisdiction only after a full hearing was conducted.

"This is high-handed and I cannot stay here," lawyer James Millar told B.C. Human Rights tribunal member Murray Geiger-Adams. "I would be consenting to an illegal process. It's too bad you wouldn't listen. With your leave, I'll leave."

He was furious with Mr. Geiger-Adams, who insisted on starting the four-day hearing before determining whether the tribunal even has the authority to hear the case.

A very sensible attitude indeed. Sure if one is outraged within it can do one more harm, outrage being a very human reaction. As long as you both could walk away from it, ok.

We have an Indian casino in nearby Bay Mills, Michigan. A friend who is native sneaked us in a comedy show, like we were also Indian. The style was first a family style guy and he got lots of laughs. Then came a sort of racy and sometimes in ones face person- still lots of laughs. Thus we were set up to patronise a show or two.

Another time a comedian came on, as we had paid that time the entry fee. He drank nine tequilas, sending a girl up to the bar. A small group here and there got up and left. The hotel complex is in the building and guests could get "plastered" and not offend by driving. Women were the worst, as he used a whole comedy on a woman's vagina. They were egging him on. Openly urging him to come and visit.

I did not leave with my wife, who took off with her friend, they were not indignant, just thought it was not funny. Afterward, I then played the mechanical horse races at a quarter a race- lots more fun and a free drink too.

Evidence of the high and mighty attitude of these so-called tribunals. Hopefully they have aroused the ire of the judiciary here. Too big for their boots methinks.
