I don’t know about the rest of you, but I’m not planning to recognize such a result as legally binding. I’m not going to pretend to obey any dictates from federal health-care bureaucrats that have never been authorized by a constitutional vote of both houses of Congress. I will not submit to any extra-constitutional order to dismantle the consumer-driven health plan I have set up for my employees.

I will not comply. If the government tries to make me comply, I’ll sue. And I’ll win.

This is not (yet) a banana republic where constitutions are seen as inconvenient impediments to the rule of the despot. This is not (yet) a European-style welfare state where some powerful parliament can exercise legislative, executive, and judicial power all in one stroke. This is a constitutional republic in which government power is divided, its exercise is strictly limited, and our rights are not some generous gift of those in power, to be withdrawn at their whim, but are instead a permanent check on their power.

Here’s my screed:

When this “health care for all” crap passes, right now the legislation states that it will be illegal to sell private policies over the date of passage. It also says that HSA’s will no longer be allowed. That means that my current policy will no longer be allowed and neither I nor my employer will be allowed to privately purchase an alternative.

I will not accept the “public option” that I will be dictated to join. I will not give the government control over my physical body. I will not pay their fines, I will not surrender to the impending warrant for my arrest. When they knock on my door, I will not answer. When they kick it in, I will make the news.

How’s that for unification, libtards? You loons are currently legislating my death. I will chose the terms and I will bring as many of you along as possible!

I will applaud anyone who takes this stand. I will side with them in court. Sadly, though, I'm not so sure that a real American would win, even with such a strong case. The socialists will do their best to stack the deck, and as long as we play in their playground (the courts), they have the advantage.

This is another reason whatever deem-wit came up with this strategy needs to have their head examined.

Not only would it be a political disaster ... the Cornhusker Kickback times ten ... but it would destroy any remaining legitimacy Obamacare has after it is “passed.”

It would guarantee that far from the Democrats’ health care travails ending, they would just be starting.

Your precedent is United States vs Reynolds. The SCOTUS ruled that coercing a citizen to enter into a contract created a “wheel of servitude” which is banned under the 13th Amendment.

This is true. The ONLY thing that will make these tyrants sit up and take notice is a total stoppage of MONEY. No payments, no withholding, no nuttin!....up your deductions to the max. Delay delay delay .....

Given the Democrat plan to illegally enact this abortion, it would not surprise me if they totally ignore any court ruling and just go on and collect the money and bully those people too timid to fight back. Money and their access to it readily is key. It would not take much time for them to feel the pain of the lack of it. For with it, goes their power, period.

Like so many other NRO readers, I’m feeling thankful right now that there are so many brilliant lawyers hanging around here to give us the straight story on the Democrats’ impending assault on the Constitution. As a non-lawyer, I took a different tack in my Carolina Journal column today: I offered to be a plaintiff. I have decided that I will not obey the dictates of any federal bureaucrat who tries to impose a tax or regulation on me by citing the authority of an Obamacare bill that fails to pass both houses of Congress as required by our Constitution.

To put it bluntly, then: I will not comply. If the government tries to make me comply, I’ll sue. And I’ll win.

Here’s an exercise when talking to libs.

Try to get them to admit that every policy implemented through the government is done with the inherent threat of the use of deadly force for non-compliance.

In other words, try to get them to admit that they advocate having people KILLED if they don’t go along with this policy.

Most won’t. They’ll do everything possible to avoid that reality. They’ll change the subject, talk over you, or put their hands over their ears and yell “na na na I can’t hear you!”

Thing is, unless you're actually willing & able to go without health insurance (some of us can't), your coverage will be manipulated into compliance. To stay in business, insurers will just comply, and won't give you an alternative.

This is the trick the Leftists have learned: don't control the population directly, control a politically disinterested intermediary instead - if they want to stay in business, they'll comply, and you'll whine and moan and comply by proxy.

It would also be nice if at least elected official, a Bachmann type, would come on the air and tell the American People not to comply.

It’s one thing for Americans to “disobey”

It’ll be a popcorn-worthy Constitutional Crisis if elected Republicans come to the floor and urge American citizens to RESIST.
