I would rather this guy's gun purchases be delayed until he's cooler-headed, than to have to read about another disgruntled gunman that prompts more anti-gun legislation.

Florida's mental health statute is known as the Baker Act (1). Like such laws in most states, Florida's statute requires evidence of a mental illness and harm to self or to others, or of neglect in order to initiate a short-term involuntary “Baker Act examination.” Baker Act examinations can be initiated by mental health professionals, law enforcement officials, or judges. Examinations take place at the more than 115 designated Baker Act receiving facilities in Florida and can last up to 72 hours. Designated Baker Act receiving facilities may be stand-alone units or may be located in general hospitals with psychiatric units, in psychiatric hospitals, or at community mental health centers with residential units.
If he made threats that could plausibly be carried out then “harm to self or to others” could be a trigger.
Well, if he made REAL threats, they don’t need to Baker Act him. They could charge him with terroristic threats... so I don’t suspect he made genuine threats. He probably dropped some solid hints and veiled threats... stuff like, “You know, this sort of treatment could get a man so worked up he’d kill a bunch of people. Oh well, luckily that’s not me. Hey, I gotta run to the gun store.”

can’t say I blame cops for checking out a pissed off fired guy who goes out and buys several guns right after his dismissal especially if he made public threats

Well, in the N.O. situation the local police ‘lost’ a lot of those arms that were confiscated. By ‘lost’ I mean that some found their way into officer’s private collection.
Hopefully, this guy gets a good lawyer associated with the NRA-ILA and not only wins a retirement fund but also signals a warning to other police depts.
The only way that this will send a warning is if the individual NKVD police officers face punishment.

Your secular argument is impressive. You are correct that on a strictly political conservative board a spiritual argument is trumped.
Do you believe in demon possession and affliction? Would you as a citizen take steps to disarm a relative or friend of yours so afflicted? Would an officer of the state being guided by conscience in addition to the letter of law be wrong in doing so?
Perhaps I was mistaken that having been endowed by the Creator with certain inalienable rights means that there is a higher law than the US Constitution.
