now where the hell in the constitution does it state the Fed Govt can do this?

Not to worry, there are exemptions if you are in a union, or if you are Amish. If you can accomplish both at the same time, you get a double exemption, which will amount to a health care credit, which means the government will pay you to get sick. At least, that's the way I think it works...
