Congress’s Constitutional Contempt Should Worry Us

At Speaker Nancy Pelosi’s Oct. 29th press conference, a CNS News reporter asked, “Madam Speaker, where specifically does the Constitution grant Congress the authority to enact an individual health insurance mandate?”

Speaker Pelosi responded, “Are you serious? Are you serious?” The reporter said, “Yes, yes, I am.” Not responding further, Ms. Pelosi shook her head and took a question from another reporter.

Later on, Ms. Pelosi’s press spokesman Nadeam Elshami told CNSNews.com about its question regarding constitutional authority mandating that individual Americans buy health insurance. “You can put this on the record. That is not a serious question. That is not a serious question.”

Suppose Congress was debating a mandate outlawing tea-party-type protests and other large gatherings criticizing Congress. A news reporter asks Ms. Pelosi where specifically does the Constitution grant Congress the authority to outlaw peaceable assembly. How would you feel if she answered, “Are you serious? Are you serious?” and ignored the question. And what if, later on, someone from her office sent you a press release, as was sent to CNS News, saying that Congress has “broad power to regulate activities that have an effect on interstate commerce,” pointing out that demonstrations cause traffic jams, and therefore, interferes with interstate commerce?

Speaker Pelosi’s constitutional contempt, perhaps ignorance, is representative of the majority of members of both the House and the Senate. Their comfort in that ignorance and constitutional contempt, and how readily they articulate it, should be worrisome for every single American.

It’s not a matter of whether you are for or against Congress’ health care proposals. It’s not a matter of whether you’re liberal or conservative, black or white, male or female, Democrat or Republican or member of any other group. It’s a matter of whether we are going to remain a relatively free people or permit the insidious encroachment on our liberties to continue.

Where in the U.S. Constitution does it authorize Congress to force Americans to buy health insurance? If Congress gets away with forcing us to buy health insurance, then down the line, what else will they force us to buy; or do you naively think they will stop with health insurance? We shouldn’t think that the cure to Congress’ unconstitutional heavy-handedness will end if we only elect Republicans. Republicans have demonstrated nearly as much constitutional contempt as have Democrats. The major difference is the significant escalation of that contempt under today’s Democratically controlled Congress and White House with the massive increase in spending, their proposed legislation and the appointment of tyrannical czars to control our lives. It’s a safe bet that if and when Republicans take over the Congress and White House, they will not give up the massive increase in control over our lives won by the Democrats.

In each new session of Congress since 1995, John Shadegg, R., Ariz., has introduced the Enumerated Powers Act, a measure “To require Congress to specify the source of authority under the United States Constitution for the enactment of laws, and for other purposes.” The highest number of co-sponsors it has ever had in the House of Representatives is 54 and it has never had co-sponsors in the Senate until this year, when 22 senators signed up. The fact that less than 15 percent of the Congress supports such a measure demonstrates the kind of contempt our elected representatives have for the rules of the game — our Constitution.

If you asked the questions: Which way is our nation heading, tiny steps at a time? Are we headed toward more liberty, or are we headed toward greater government control over our lives? I think the answer is unambiguously the latter — more government control over our lives.

Are there any signs on the horizon that the direction is going to change? If we don’t see any, we should not be surprised. After all, mankind’s standard fare throughout his history, and in most places today, is arbitrary control and abuse by government.

The government that is currently ruining our lives and our economy forever is contemptuous of Americans asking questions. They are so contemptuous of those questioners that they never answer the question as to do so would be to reveal them as to what exactly they are and what exactly they are doing to this once great nation.

There are very few things that are going to stop them. They already own the ballot boxes and the voters both living and dead. What they do need is a taste of their own medicine. They will have to be bodily thrown from the buildings of Congress into the Potomac River.

Illegitimate political system = illegitimate government. Our one-party system will not solve the problems we face. The answer is for Free Americans to find a way to peacefully separate from the liberal fascists who control American institutions: government,the financial system, major corporations, academia, the press - far out of proportion to their numbers or popular support. Our founding documents allow - rather, they compel us to do so. Non-violent revolution, separation, and return of power to the people are the mechanisms of hope and change - not our illegitimate political system.

First thing when we gain control of the Congress is we pass a special tax that RUINS the Pelosis and strips them, their children, and their grandchildren of any wealth they might have now or in the future.

Now I know that this sort of thing is "prohibited" by the Constitution, but there's no doubt that Nancy's own justification of this piece of legislation will be sufficient to ward off all concerns.

Article 1 Section 8 does not specifically nor expressly grant Congress the power to regulate health care. This is the only salient point regarding health care. People need to drive this point home with their politicians!

Nazi Pelosi and her fellow fascists are the epitome NOT of what is commonly called the 'culture of corruption' (although they are certainly corrupt), but in fact are the 'culture of Communism' for that is exactly what she and her counterparts in the Senate, and the Mugabe-wannabe in the White House are establishing in our former Republic.

Whatever checks and balances existed are virtually gone. The Supreme Court of the United States is effectively in 0bama's pocket. We will find no help there.

Only our military forces who still place their highest loyalty to our Constitution, in addition to millions of Americans who are armed to the teeth, have a chance to stop these megalomaniacs from reaching their Soviet-style goals.

Plus, they don’t seem to be spending too much time paying attention to previous Supreme Court decisions!

That she can act so brazenly certainly scares me as it should scare the daylights out of everyone. I cannot help but wonder if she truly believes she is above the law and that she can even begin to think that she can fool people into thinking she is acting without any nefarious motives e.g. simply lust for more power. When does a little girl turn into a monster. The questions is not what do we do to fix this, but, when do we act to fix this.

I would count on the Supreme Court to be intellectually dishonest in its read of the constitution and precedent.

Justice McReynolds also found the 1934 GCA unconstitutional if it was applied to guns used for the common defense or by an organized militia, but in 2009, Scalia asserted that the Miller decision stood for the opposite of what it actually says.

The Linder case is about unregulated sale of morphine - I'm thinking that a later case has reversed, otherwise the entire "federal schedule" for opiates would be invalidated.

As for "forced insurance," see SS and Medicare, Ponzi schemes kept afloat by confiscatory federal taxes.

What is so new about this? Congress has been ignoring the Constitution for the United States (except when it suits them) for well over 144 years.

Lincoln calls (unconstitutionally) up 75,000 militia to fight his unconstitutional un-civil war.

Zip ahead a few years and we have Wilson approving the unconstitutional 16th and 13th Amendments.

Whether republican (with the exception of Ronald Reagan) or democrat, both continue to call us a democracy. Both continue the talk about smaller government, yet it keeps growing by leaps and bounds. Both keep talking about lower taxes but, they as with government keep growing.

This crap with Pelosi is not new. The only real difference is she is so brazen and / or so ignorant of the constitution that she actually believes the government has the duty to care for us peons from cradle to grave.

Again the only way to return to a constitutional representative republic is to stop voting republicrat and vote
