Senate panel approves Democratic climate bill

WASHINGTON (Reuters) - The U.S. Senate Environment and Public Works Committee on Thursday approved a Democratic climate change bill that would require industry to cut emissions of carbon dioxide and other greenhouse gases 20 percent by 2020 from 2005 levels.

With Republicans boycotting the committee's work saying more analysis of the legislation was needed, 10 Democrats voted to approve the legislation and one Democrat, Senator Max Baucus, voted against it.

The bill will now become one of several initiatives aimed at attacking global warming. Senator John Kerry is leading an effort with some Republicans and the White House to craft a compromise bill, which likely would not be voted on by the full Senate until next year at the earliest.

John Kerry is leading a compromise effort? ....the same Kerry that has tried to eradicate the CRS report on Honduras from the Library of Congress!

In the VietNam era, I saw Kerry as a traitor to his country and his fellow servicemen. His stance on abortion convinced me that he is a traitor to his *stated* religion. My opinion stands.....and has increased.

I do NOT trust anything Kerry does.

Law? Maybe a Senate rule. Do you know what rule it is, and what repercussions there are for a bill passed out of committee without two members of the minority present? One would think that at the very least they could get it to the Senate floor through a discharge petition.

This bill is dead. There’s no way the Senate will pass cap and trade in an election year. Same goes with ObamaCare. We need to keep the delay games going. If it gets pushed to the next congress, they have to start all over.

Their plan is to pass “take over of medicine,” pass “tax and bleed,” and initiate the “carbon-credit market.”

They’ll do that as fast as possible.

And then they will grant amnesty to all the illegals in this country AND THOSE CURRENTLY IN LINE TO BECOME CITIZENS LEGALLY. It will be passed in one fell swoop.

At that point, the DNC will be able to look at all the fairly conservative Dems, the independents and moderates, and flip them the bird with a big, smug smile.

Barbara Boxer plans to bypass Republicans on climate vote

Senate Environment and Public Works Chairwoman Barbara Boxer (D-Calif.) plans to exploit a committee loophole and completely bypass the GOP on Thursday if Republicans continue their boycott of the legislative markup, according to Democratic aides and lobbyists.

Republicans have refused to attend the markup of the legislation until the Environmental Protection Agency delivers an additional analysis of the bill.

Some aides have described this decision to pass a bill without any Republicans present as a “nuclear option” because it bypasses the usual custom of having a few Republicans there for a quorum.

EPW Committee rules state that opening a “business meeting” requires one-third of the members of the committee, including two members of the minority party. But legislation can be approved by the committee with a simple majority of members, an exception Boxer could use to pass her bill.

We’ll need lawsuits against this and the healthcare bill. The only way they can be stopped is in the courts. I hope to God someone is planning to sue. The Supreme Court is the only way to stop them from turning the US into a socialized country.

So here we are at the second day of Kerry-Boxer markup and the second day Boxer chose to proceed without GOP representation, despite committee rules requiring two members of the minority be present in order to provide a quorum for a markup.

It seems Boxer cited a “provision in the rules” she claims allows her to proceed as long as a majority of committee members are present. Not that I don’t trust her, although I most certainly do not, but I thought a quick trip over to the EPW rules site for a look-see was in order.

Now, according to Rule 2 of the committee rules: [my emphasis]
“At committee business meetings, and for the purpose of approving the issuance of a subpoena or approving a committee resolution, one third of the members of the committee, at least two of whom are members of the minority party, constitute a quorum, except as provided in subsection (d).”

And it appears to be the language of subsection (d) that Boxer is attempting to play games with:
“No measure or matter may be reported to the Senate by the committee unless a majority of committee members cast votes in person.”

From a layman’s reading, one would surmise that although the bill can be reported out of committee with a simple majority, at least 2 Republicans need be present to consider any amendments. In which case, Boxer’s decision to continue markup sessions without minority representation would be as illegal as it is unprecedented.
