"The suspect -- Jesse Neri Jr. of Visalia -- allegedly broke into a house in Orange Cove, but left quickly when the alarm went off.

He dropped his cellphone, which authorities picked up.

On it, they found contact numbers for Neri, and called him, without identifying themselves.

They offered to return his cellphone if he would meet with them.

He did, and was taken into custody."

Last year these dudes broke into an apartment and stole a bunch of stuff including a digital camera. The took a bunch of photos of themselves whooping it up. They didn’t know the camera had a wi-fi card and the photos automatically loaded to the real owners web-site. The were apprehended shortly after.

Not exactly conclusive proof. Neri could maintain that the “real thief” stole or found his cellphone. I wouldn’t bet money on it, but an attorney could make a case for it as an alternate theory, raising reasonable doubt.
