US Judge dismisses lawsuit against Hillary Clinton
Times of India ^ | July 17, 2009

WASHINGTON: A federal judge has thrown out a 13-year-old lawsuit against Hillary Rodham Clinton that involved the White House's handling of FBI background records.

The case extends back to the secretary of state's time as first lady and has included a voluminous record of nearly 1,500 legal filings. Clinton was summarily removed as a defendant in a three-page opinion by US District Judge Royce C Lamberth.

Attorneys who have pursued the case, sometimes known as "Filegate," had argued it should not be dismissed until Clinton has testified. Lamberth disagreed, saying there is no legal reason that he should "require a person who is a busy Cabinet secretary at this point to submit to an oral deposition."

The FBI file controversy erupted in 1996 when the administration of President Bill Clinton, Hillary Rodham Clinton's husband, acknowledged it had sought and received FBI files of hundreds of prominent Republicans. The Clinton administration already had been under investigation for the firing of White House travel office employees.

The Clinton administration said the files were requested because President George H W Bush, like other presidents, had taken all the White House personnel files with him upon leaving office, even those of permanent White House employees.

Republicans accused Clinton of misusing the FBI to get information on political enemies. An independent counsel report in 2000 found no evidence of wrongdoing by White House aides or Clinton.

That explains why she was named Secretary of State. Needed Obama to make this pesky problem go away.

The priveleged class. I guess you have protection from the law when you work for Obama.

I guess the Times of India was the nearest MSM outlet that would run this story?

“”Lamberth disagreed, saying there is no legal reason that he should “require a person who is a busy Cabinet secretary at this point to submit to an oral deposition.””

Weren’t we counting on Lamberth last week to come up with a correct ruling in another case? I do not remember the case we discussed here. Help!

This is disappointing. If Hillary has too many responsibilities now as a Cabinet Secretary, why wasn’t this taken care of when she was a Senator? Same thing would apply, I guess. Too busy messing up the country!

This is the very first time I have ever heard the excuse that the former President Bush took all personnel files with him when he left the WH. Why would it matter anyway? The files supposedly gathered by the Clintons weren’t those of WH personnel!

Lamberth is a pretty good Judge. During the Clinton years he ruled against Clinton 21 or 22 times out of 23 attempts by Clinton to hide stuff.

“US Judge dismisses lawsuit against Hillary Clinton”

Should read:

“US Judge dismisses lawsuit against Hillary Clinton with a wink and a nod- Hillary avoids yet more criminal convictions thanks to activist judges with agendas”

no legal reason that he should "require a person who is a busy Cabinet secretary at this point to submit to an oral deposition.

And yet there is more than enough time to bother an Alaskan Governor with 18 bogus ethics complaints...
