Pawlenty won't delay if court rules for Franken
Politico ^ | 6/28/09 | Josh Gerstein

Governor Tim Pawlenty (R-Minn.) said Sunday he has no plans for further delay in certifying the results of the state's disputed U.S. Senate election so that Republican Norm Coleman can pursue a federal court challenge.

Pawlenty told CNN that he would abide by whatever ruling the Minnesota Supreme Court makes in the contest, where Democrat Al Franken appears to have an upper hand.

"I'm prepared to sign [the certification] as soon as they give the green light," Pawlenty said. “I’m not going to defy an order of the Minnesota Supreme Court. That would be a dereliction of my duty."...

Minnesota has got to have some sick folks there for them to vote Franken for their Senator. Doesn't anybody research their candidates anymore?

Just read the comments and you’ll see the kind of loonie toons that might have voted for Franken.

When are the Supremes going to make their ruling anyway?

“I'm prepared to sign [the certification] as soon as they give the green light,” Pawlenty said. “I’m not going to defy an order of the Minnesota Supreme Court. That would be a dereliction of my duty.”...

This is an absolutely incorrect statement. As Governor he is expected, no, required to fight the Supreme Court if he believes they are acting against the Constitution of the U.S. or Te State of Minnesota.

This is the type of Sh** that really chaps my hide. There are three EQUAL branches of government and the constant deference to brain dead activist judges is cowardly at best. If he believes that the Supreme Court rules in an illegal manor he is required BY LAW to fight them in Federal Court.

I’m with you, but since when did we give the USSC the final say? I can’t figure that one out.

If they say something is not constitutional and the executive branch disagrees ... where does it end?

There’s a flaw in this ointment.

Are they at least going to let those 2000 dead Franken voters RIP before they come up with a final tally out there in Frostbite Falls?

I dont believe that Franken legitimately won the election. The revote was gerrymandered to put him over the top by the Soros-sponsored Sec. of State.

On election night, Coleman was the winner. A recount should be a recount of the votes counted on election night, not an opportunity to find more votes in RAT car trunks and under every rock in every lefty district of Mnpls.

These dems have voter fraud down to a science. Just stop and think how many races have come down to recounts recently.

If the election were today, Franken would lose big.

That’s because Democrat votes are like Tribbles...

Maybe the people of Minnesota have a good handle on the calibre of the US Senate. Franken may actually RAISE the quality of output, as well as the honesty quotient.

The real way to end it for the Congress to limit the powers of the court. They can instruct the coutrrt that they can not rule on certain things.

The congress and the executive branches are the will of the people. Activist judges are tyrants and can and should be put in their place or removed through impeachment process.

Marbury v. Madison. If John Marshall wouldn't have been Chief Justice, this country would probably look a whole lot different today. Before Marbuy v. Madison, SCOTUS met in an empty, and small conference room in the still-under-construction US Capitol.

I was thinking that every USSC decision should be approved by either the executive branch or by 2/3rds majority of congress before it has the force of law. That way you have at least two out of three branches agreeing.

Impeachment is for only “treason, bribery, or other high crimes and misdemeanors”.

Maybe our definition of treason should be honed.
