A Texas man has reportedly settled a class action lawsuit against Hooters for refusing to hire men as food servers.
Nikolai Grushevski filed a complaint against Hooters of America in January alleging its Corpus Christi franchisee would not hire him as a waiter because the position was being limited to females by an employer "who merely wishes to exploit female sexuality as a marketing tool to attract customers and insure profitability."
Hooters argued a bona-fide occupational qualification defense, which applies when the essence of the business operation would be undermined if the business eliminated its discriminatory policy, according to Onpointnews.com.
If we lose this go around, you can next expect hairy-legged guys in the Rockettes to line up and male models in the Sports Illustrated swimsuit issue." Hooters' vice president of marketing said, according to Onpointnews.com.
But the website reported that court records show that Grushevski and Hooters reached a confidential settlement on April 13.
Grushevski was suing on behalf of all males across the country who applied for the position of waiter at a Hooters restaurant and were denied, and suggested all Hooters franchisees be certified as defendants, Onpointnews.com reported.

He has no chance. Hooters can discriminate based on the uniqueness of their business.
The one here has shut down.
YUCK! I don’t want a male waiter at Hooters.
Mr. Ski, it’s HOOTERS, not GOOBERS.
Heh... I wonder what stops a short whitey fat guy from suing the NBA for not being allowed to play?
Dale Gribble, are you out there?
There are three within 10 miles where I live; Chantilly, Fairfax, and Manasses.
I went to the one in El Paso and my party of 3 had to wait about 50 minutes for a tables. I was surprised at the number of families and women group customers. The young ladies were gorgeous. I would have married every one of them.
Klanburger and Klux Chicken House are relieved.
I don’t know, but I’m calling my lawyer in the morning.
Mr.Grushevski either doesn’t know the meaning of “The Eyes of Texas are upon You” or just didn’t care. My money says he didn’t care.
This one wasn’t open long. Maybe over a year. We never tried it.
I saw go for it. With our hypersensitive, overlitigious, PC-on steroids society, it’s worth a shot.
“The young ladies were gorgeous. I would have married every one of them.”
With the way our legal system is going, just give it a few years. You’ll probably get your chance.
Very few professional airline pilots are blind too.
The food is no worse than fast food fare. Their Tilapia sandwiches are good.
I have eaten there maybe 4 times in 12 years.
Here’s a clip of the guy being interviewed about the issue. Apparently, he wasn’t the first one to sue over this issue:
The clip is on the page - it’s not a direct link
Now, you just *know* the next thing will be a transgender lawsuit fighting for the right not only to work at Hooter’s but to wear the same outfit as the gals (right down to the short-shorts and shiny tights).
BTW, I’ve never eaten at a Hooters. Not my scene at all. I’d rather have a grandmotherly type telling me “you should eat more, you’re so skinny. You’ll never find a nice girl to marry without a little meat on your bones.”
:-)
**I wonder what stops a short whitey fat guy from suing the NBA **...
I said that for the first time in 1975... when I sat with the HEAD OF PERSONELL at IBM... He said... “Your Experience is exactly what we need, your References are top notch, but I can’t Hire you... you’re the wrong color, gender, religion ...”
“If you can’t do that...I’m going to sue the NBA for not hiring me...” 200 pound white guy standing 5’9” I went and got DRUNK, but I did make the guys day!!!
Funny you should mention that. Michael Savage suggested(sarcastically, of course) some weeks ago that it wasn’t fair that blind people were not legally allowed to fly and should sue for discrimination.
Coon Chicken Inn was the first tasteless restaurant.
