Lawmaker angry over reluctance to enforce immigration law (Salt Lake Police Refuse)
KSL ^ | 8 April 2009 | Andrew Adams

There may be retribution for police not enforcing Utah's new immigration law.

Senate Bill 81 makes it more difficult for illegal immigrants to get a job and to utilize some government services. But the responsibility of enforcement falls on police.

Detective Dennis McGowan says Salt Lake police won't be enforcing it as it is written because it implies a form of racial profiling.

Rep. Mike Noel, R-Kanab, was the House sponsor of the bill. He says he's angry, it's appalling and he will look at ways to make the Salt Lake City Police Department uphold the law.

"If they don't want to obey the law then I guess we're going to have to in some way have some retribution against them for not enforcing the law. So that would be my statement, and I would work hard to do that," he said.

McGowan said Tuesday, "Everyone is entitled to access to law enforcement and to have the peace of mind in doing so."

"[Senate] Bill 81 implies a form of racial profiling that's in sharp contrast to the basic principles, beliefs and core values of the Salt Lake City Police Department, and therefore we will not participate," he said.

Other police agencies have come out against SB 81. Even some lawmakers acknowledge it's not the best solution. It goes into effect July 1.

There's concern among some community leaders that many Latinos will simply leave the state.

Typical race baiting garbage. They can tap into ICE databases and check everyone they pull over (the profiling line is total BS).

There's concern among some community leaders that many Latinos will simply leave the state.

I don't care who they are, if they are here illegally, I say: Don't let the door hit you on the way out.

Salt Lake cops pick and choose the laws they prefer to enforce? We used to have a name for that here in Texas…

Disco Cops.

“There’s concern among some community leaders that many Latinos will simply leave the state.”

And the downside of that would be? Lowered social services costs? Less crime? More opportunities for Utahans to get entry level jobs?

Noooo. More like a promotion in SLC.

If SLC wants the illegals, let the city take them all in. Noel should draft a bill requiring SLC to pay for all the social services and law enforcement by itself. They want the problem, let them have it and be responsible for it.

I think they already do that as SOP when they pull someone over anyway. The problem with plates is that it doesn’t tell you a whole lot about the driver and occupants (let alone if they are legally here or not).

Why would American citizens or legal residents want to leave?

This IS race baiting garbage. To try to mix Americans and legal residents of hispanic descent with illegal f'n aliens of hispanic descent is a low trick.

Illegals and their anchor babies need to leave NOW. They are criminals and parasites. That most are of "hispanic descent" is irrelevant to the discussion.

“They want the problem, let them have it and be responsible for it.”

And if any other community suffers from the presence of illegals, send the bill to SLC. As a matter of fact, that ought to be the law across the land, as pertains to ANY sanctuary city.

Wow, what happened to these f$%^heads just enforcing the law like they are supposed to do? Oh wait, they will refuse to enforce this kind of law over racial profiling. Will we see the same level of outrage and refusal to implement if a law is passed overturning explicit rights in the Constitution?

I won't hold my breath.

McGowan should be removed from his position immediately. His job is to enforce all laws, not just the ones he agrees with.

A truly incredible statement. This is police state language. It should frighten anyone, left or right, to have a police agency decide which laws it will openly ignore. This man needs to be relieved by the national guard immediately like you would a corrupt Mexican police agency. Police *do not* get to decide which laws measure up to what they believe and announce which they will ignore.

Incomprehensible.

This pond scum of a cop is announcing that his department has basically installed itself as a Utah supreme court, empowered to review new laws. I assume the “detective” is a PIO mouthpiece for the chief?

Shows their true colors. They really only want to enforce laws that have something in it for them. Money, praise, whatever. Too much trouble to enforce all laws, fairly, and equally. Since they can/have to pick and choose they pick PROFIT.

I’m not surprised in the least.

I’ll bet you that the Detective is head of the local police union and since Obama is a union supporter and supports decrease in ICE Immigration raids, he is supporting that position

Paying police officers who choose not to uphold the law isn't in keeping with my principles. When any officer chooses that action, including the police chief and his subordinates, they need to be suspended without pay. Make it a 3 day suspension. Make it stick with a 3 strikes provision. The third time they do it, they are terminated.
