California congressman's Maryland tax break under scrutiny (D - Pete Fortney Stark)

Reporting from Washington -- Rep. Pete Stark (D-Fremont), dean of the California congressional delegation, has claimed his Maryland home as his principal residence to qualify for a $3,770 tax break, even though it is thousands of miles from the Northern California district he represents -- and where he is registered to vote.

A senior member of the House's tax-writing Ways and Means Committee, Stark said he was unaware that he might not be eligible for the tax break. Asked whether it was questionable for him to receive it, he said, "I guess it is."

To qualify, a property must be the owner's principal residence: He or she must live there at least six months of the year, use the address for voter registration and driver's license purposes, and file Maryland income taxes.

Stark is registered to vote at his wife's parents' address in San Lorenzo and has a California driver's license. He said his 3,600-square-foot Maryland home, on 6.35 acres with an assessed value of about $1.6 million, is the only residence he owns. He rents a town house in Fremont.

Stark is the latest lawmaker to come under scrutiny for claiming the tax break. Recently, authorities revoked a tax break that Rep. Eliot L. Engel (D-N.Y.) had claimed on a Maryland home.

Stark, 77, is an outspoken liberal who has served in the House since 1973. He once called a GOP House member a "fruitcake," and Republicans said Stark appeared ready to exchange blows in a 2003 incident in which Rep. Bill Thomas (R-Bakersfield), then-chairman of the Ways and Means Committee, called police to break up a meeting of Democrats. Stark ridiculed suggestions that a fight was about to erupt.

Stark is next in line to become chairman of the Ways and Means Committee, now headed by Rep. Charles B. Rangel (D-N.Y.), who is the subject of an ethics investigation.


I'm glad God has a sense of humor amidst all this dem-induced chaos.

Someone can provide the proper cite on this.

It is my understanding a person can have two primary residences and claim two houses. One of the benefactors of this law was members of congress who may have a home in their district (no know about this guy here) and another near DC.

That meant they could claim two sets of mortgage interest and two property tax deductions.

I welcome information to the contrary.

Re-elected 16 times and never fell below 60% of the vote. What is the thing with class envy? Why does it not apply from the SHEEPLE to their leaders?

I’d say Pete will be just fine until he dies or retires whichever one they can figure out comes first.

Stark was born in Milwaukee, Wisconsin. He received a Bachelor of Science degree in general engineering at the Massachusetts Institute of Technology in 1953.[2] He served in the United States Air Force from 1955 to 1957. After leaving the Air Force, Stark attended the Haas School of Business at the University of California, Berkeley, and received his MBA in 1960. Stark enjoyed living in the Bay Area so much that he decided to settle there after graduating.

In 1963, Stark founded Security National Bank, a small bank in Walnut Creek. Within 10 years it grew to a $100 million company with branches across the East Bay.

Stark grew up as a Republican, but his opposition to the Vietnam War led him to switch parties in the mid-1960s. He printed checks with peace signs on them and placed a giant peace sign on the roof of his bank’s headquarters.

Does he pay California or Maryland income taxes?

In California it’s 9.3% for income after deductions,etc over $40,346. Maryland’s income tax rate is: 4.75% for income over 3,001 per http://swz.salary.com/salarywizard/layouthtmls/swzl_statetaxrate_MD.html My guess is he pays tax in Maryland. He may do a multi-state filing with only a small portion going to California to cover his bases.

For giggles I also checked the District of Columbia which is totally controlled by the Democrats and especially the Democrats in Congress and it’s 9.3% over $30,001.

They write these stupid laws to make themselves feel important then turn right around and do everything they can to avoid the consequences of their own idiotic laws. They have never met a tax they didn’t like to impose on YOU, but avoid at all cost themselves.
