Obama: the only US president to be sued (part I)

On February 9, 2009, a New Jersey attorney, Mr. Mario Apuzzo, filed a lawsuit on behalf of Plaintiffs, Charles F. Kerchner, Jr., Lowell T. Patterson, Darrell James LeNormand and Donald H. Nelson, Jr.

The lawsuit, Civil Action Number. 1:09 –cv-00253 was filed in United States District Court for the District of New Jersey.

The defendants in this case are: Barrack Hussein Obama II, and Individually, a/k/a Barry Soetoro, United States of America, The United States Congress, The United States Senate, The United States House of Representatives, Richard B. Cheney (President of the US Senate, Presiding Officer of Joint Session of Congress, Vice President of the United States and Individually), Nancy Pelosi (Speaker of the House and Individually).

All of the defendants have been served with a copy of the complaint and have 60 days to respond to the complaint. Will they stand up like honest citizens and answer the complaint, or will they hide behind high priced lawyers like Obama has been doing?

Basically, the lawsuit says there is no verifiable proof that Obama is an American citizen and is therefore ineligible to be the President of the United States. It also points out that the United States Code of Federal Regulations was violated by the defendants, during the course of counting Electoral votes, by not asking any members of Congress if they objected to the counts. A normal counting of the votes takes approximately 2_hours. Obama’s took 36 minutes and it is on record that there was no call for any objections.

This lawsuit is important because, the cold hard fact of life is that if Obama is not qualified or eligible to be the President of the United States of America, every action Obama takes is fraudulent.

Not that I would quibble with Pravda but I’m pretty sure President Clinton was also sued.

Clinton was the first sitting President to be sued ... not Obama. There was a big to-do during Clinton’s term about whether a President could be sued.

Pravda’s “gift” isn’t their lies and certainly not that their truth... but the way they mix in truth with fiction and blur the lines.

When it becomes hard to tell where the truth ends replaced with a mixture of fiction and editorial spin they are doing their job. Not unlike certain American papers.

How did that work out for him?

Seriously, his unwillingness to settle that suit was either a case of legal malpractice on advice of counsel, or was Clinton's unadulterated hubris. In any case, this one probably won't end up like that one.

Anyone looking for a quick resolution, will be disappointed. In fact, by the time this works itself through the judicial system (assuming anyone will hear it to begin with) and gets to the Supremes, the 2012 election will be upon us.

I think the best thing to do is what's being done in Missouri and Florida - pass legislation at the state level requiring Presidential candidates to provide certified, long form vault copies of their Birth Certificates. It's too late for this term, but not too late for the next.

Every President is sued repeatedly during his term for actions taken in his official capacity. To pick one example; Andrew Jackson was sued by the Cherokee prior to his removing them from Georgia. When the courts ruled against him, he famously said: "They've made their decision, now let them enforce it".

The courts have built a cocoon of protection from personal lawsuits during a president's time in office but even it can be breeched in the right circumstances.
