The Punish Mark Sanford Amendment(Porkulus illegal usurpation of state's rights)

Buried in the porkulus conference report is a provision specifically targeting governors who would exercise the choice to refuse stimulus money.

It’s an obvious end-run around the authority of South Carolina Gov. Mark Sanford, the outspoken GOP fiscal conservative who has staunchly opposed the behemoth federal package.

Read it:

SEC. 1607. (a) CERTIFICATION BY GOVERNOR — Not later than 45 days after the date of enactment of this Act, for funds provided to any State or agency thereof, the Governor of the State shall certify that: 1) the State request and use funds provided by this Act , and; 2) funds be used to create jobs and promote economic growth.

(b) ACCEPTANCE BY STATE LEGISLATURE — If funds provided to any State in any division of this Act are not accepted for use by the Governor, then acceptance by the State legislature, by means of the adoption of a concurrent resolution, shall be sufficient to provide funding to such State.

This seems blatantly illegal — a complete federal usurpation of states’ budget processes.

Do the members of the Senate GOP Turncoat Caucus approve?

Nothing in there to keep a state from taxing all stimulus payments at 100% and using the money to reduce general taxation in the state, though. Heck, they could even use some of the money to help residents pay their federal taxes!

Unconstitutional? With this administration and the democratic controlled congress, that is a minor annoyance. A few more years and we wont have a Republic. I actually have started to believe that is what they are aiming for.

This puts SC in direct contenion with the Federal Govt: I say it’s time for SC freepers to contact their state reps about a “Sovereignty Resolution-Bill-Amendment”.

Absurd ... to force funds on a state Governor or states that know the funds are a boondoggle to certain groups; and justifiably do not want to destroy America with these crazy new stimulus creations, is like holding a gun to his/her head. Not constitutional is it?
