SAN FRANCISCO In a sharp rebuke to supporters of a contested state ballot measure that banned same-sex marriage, the California attorney general said Friday that the measure was constitutionally indefensible and should be overturned.
The attorney general, Jerry Brown, had previously hinted of his opposition to the measure, Proposition 8, but made his legal opinion concrete on Friday in a brief to the California Supreme Court, which is reviewing the measure. Proposition 8 must be invalidated because the amendment process cannot be used to extinguish fundamental constitutional rights without compelling justification, Mr. Brown said in a statement.

Who says that Moonbeam isn’t a crazy leftist idiot?
Like a good marxist, the peoples’ votes don’t mean a thing if he doesn’t like they way it goes.
Wow, Jerry Brown is in favor of gay marriage? Who would have thought?

“...with his candidacy for Governor in 2010.”
He can run for Governor again?
Prop 8 will not survive, regrettably.

Bummer.
Ken Starr is the lead attorney for Prop 8.

Oh, yeah? That’s a hot one! Now ask him what he thinks of the Second Amendment to the Bill of Rights of the U. S. Constitution, and be prepared to get out of the way quick, lest you be trampled as he backpedals.
What he really intends to communicate, of course, is that the law means only what Liberals want it to mean; no more, no less.
The liberals didn’t like it when Proposition 187 was passed so they simply got an activist court to get rid of it. They’ll do the same with Proposition 8. Done deal. It’s California, after all.
But really, who cares? It’s like worrying about inflation in Zimbabwe.
No point getting agita about it. Just follow your heart and flee if you can’t take it anymore.
Brown should recuse himself on this matter.
I think Prop 8 will survive, but will be eventually overturned by another amendment. After the massive gay backlash against the Mormon Church, religious institutions will think twice before donating money or advocating against gay marriage.
Churches are institutions that live or die based on public good will, they need converts and regular attendees to sustain them. Having gay activists outside your building calling you Nazis, and attacking you on blogs and newspaper pages, is the last thing a church needs. Mormons especially have a big problem with their public image, and the Prop 8 backlash definitely hurt them.
I think Prop 8 will be challenged by ballot either 2010 or 2012.
Yes, please void the peoples’ vote. We, the anointed elite, know so much more than the masses. And while we are at it, do away with those nasty elections and the Constitution. We cannot be held captive to old pieces of paper or to the people who put us in office./s
“Top Lawyer Urges Voiding California Proposition 8”
OOOOO....Top lawyer says so. Well that decides it then. If top lawyer says so I guess we will just have to void the results of Prop 8.(sarcasm)
So what if the people of California voted against the homosexual agenda.
The Dems will just use the courts to shove this immoral and sick lifestyle down our throats.
Some judges need hospital stays.
