I know the announcement is due tomorrow, but i want to caution folks that not all the BC eggs are in this one basket of a case.
It is entirely possible that the justices want to hear the controversy, but do not believe this is the right case to do it.
i wish i was a fly on the wall for that conference, because i suspect it was a doozy.

That's part of the problem with the Supreme Court - you can't FORCE them to do anything. They're unelected dictators, if they choose to be. They can rule that the First Amendment means that no on can criticize anyone with the name of "Smith", and their ruling has the full force of the law behind it. TS if you don't like it.
The Supreme Court should not and cannot ignore the Constitution!
The risk is too large to ignore. Should Obama goes on to be President, and at some point later turn out to be a fraud.
Every decision and appointment he made will be NULL and VOID !!!

You’re right. We’ve gone to war for less. What can be more important than upholding the Constitution? There is nothing more important than defending the Constitution, the law of the land. This is no mere “interpretation of the Constitution” argument, like the “right to privacy”. This is black and white. Either this person is qualified as outlined clearly and succinctly by the Aritcle II Section 1, or he’s not. Are the facts surrounding his life circumstances true or not? Was his father a British subject at the time of his (NObama’s) birth or not? Does that give him dual citizenship, at best? Which is not good enough. This is not that hard to determine.
Loads of supposed “conservatives” are saying they will not touch it, let’s get them in 2010 and 2012 nonsense.
Leo gets it. It is about the power of citizens over a corrupt legislative and executive (to be) branches of govt. The judicial branh is the 3 branch that is supposed to protect the Constitution and citizenry against abuses by the other two branches of govt. Each branch is supposed to check the others power.

The other day when O. J. got convicted groups was outside yelling racist at the courts. Imagine what will happen if BHO doesn’t get the presidency.

If the Supreme Court does not address the Donofrio case, I have a major problem with them. Donofrio’s brief addresses the Obama and McCain eligibility problems, but the other egregious eligibility problem he points out is the Calero issue. This guy was born in Nicaragua and is not even a citizen. He was on the ballot in several states running for President. The Calero issue is a no brainer and is part of the case. I think putting Calero in the suit is what got their attention and I don’t see how they can afford not to address it.

Shame on them! I decided after listening to to rush for 18 years that his silence on this issue has made me decide to turn off my radio too.
I am temporarily going to play devils advocate here.
The SCOTUS will pass this up on several levels, first off because of the major disruptive issues that will entail afterward”s. First off would be the fact that every issue, nominee and position given out by Obama would have to be nullified, this cannot happen, a rotten potato has been placed under a massive pile of other potatoes and looking for and finding the rotten one will only damage the rest.
So in the eyes of the courts they do not want to damage the pile.
Another aspect of why this case will go nowhere is that if they did eventually find because of Obamas dual citizenship that future political candidates running for ANY office must follow those guidelines of natural borne unless they knew that at a later stage like the governor of California they could never be nominated for presidency, in Obamas case he probably never thought he had a chance to get where he is now and thus surfed on what credentials he did have which were enough until certain groups saw him as the answer to their prayers and moved him further up with massive cash influxed over several years with the manipulation of the MSM to promote his position towards becoming POTUS..
So they cannot enforce the requirements of the Constitution because it would require a complete overhaul of the election system making it too honest and fair, it would backtrack to too many offices and lawsuits about eligibility factors.
And then of course is the fear factor that they are afraid of flaming cities of deranged supporters running amok and challenging authorities.They are also afraid of past skeletons coming out of closets possibly their very own.
Obama will become President because he has studied for years all the loopholes of getting the Presidency, in effect he has become the ultimate lawyer using words and twisted facts that the jury can only believe because if they questioned anything it would mean years of sequestering and nobody wants that.
My money is on them ignoring any elgibility issues.

You not need a majority of the members of the SCOTUS to move the case against Obama forward. Rather, you just will need the support of the four Strict Constructionist justices.
They are:
Roberts
Scalia
Thomas
Alito
I trust that these four Great Men will uphold the Constitution.
And I am sure that on Jan. 20th Chief Justice John Roberts will deliver the oath of office to Barack Obama.
And while I might not like that, the Constitution will be upheld.
