Indiana: Charge ACORN with RICO

Indiana Secretary of State Todd Rokita said his office has found evidence of “multiple criminal violations,” possibly involving state and federal racketeering laws, in connection with fraudulent voter registration applications.

Rokita, Indiana’s top election official, sent a letter last week to U.S. Attorney David Capp and Michael Welch, special agent in charge of the FBI’s Indianapolis office, presenting the findings and requesting prosecution.

The letter also went to Bernard Carter, prosecutor in Lake County, Ind., where the probe turned up more than 1,400 fraudulent applications.

The allegations are aimed at the Association of Community Organizations for Reform Now (ACORN), which is being investigated for similar issues in more than 10 other states, the Indianapolis Star reported.

ACORN officials have confirmed that the group submitted hundreds of potentially bogus registration applications earlier in October. The officials maintain that they are required by law to submit all applications they collect, and claim the organization was the victim of unscrupulous employees who collected the applications in Lake County.

But Rokita states in his letter that “complying with the law to submit legitimate applications does not allow ACORN officials to evade the law against knowingly submitting fraudulent applications.”

Submitting fraudulent applications is a Class D felony, according to the Star.

Rokita disclosed that a preliminary investigation indicated ACORN “violated Indiana’s Racketeer Influenced and Corrupt Organizations (RICO) law.”

He also wrote that the organization and its officers and employees “violated Indiana election laws with respect to the solicitation, completion and submission of incomplete, forged or fraudulent voter registration applications, and “with respect to the submission of multiple voter registration applications for the same person.”

Mary Hatton, spokeswoman for the U.S. Attorney's Office in Hammond, Ind. declined comment, as did FBI spokeswoman Wendy Osborne, according to the Northwest Indiana Post-Tribune.

In a statement, Deputy Attorney General Rich Bramer said the office is ready to assist any investigation opened by local or federal officials.

(A) No person shall knowingly register or make application or attempt to register in a precinct in which the person is not a qualified voter; or knowingly aid or abet any person to so register; or attempt to register or knowingly induce or attempt to induce any person to so register; or knowingly impersonate another or write or assume the name of another, real or fictitious, in registering or attempting to register; or by false statement or other unlawful means procure, aid, or attempt to procure the erasure or striking out on the register or duplicate list of the name of a qualified elector therein; or knowingly induce or attempt to induce a registrar or other election authority to refuse registration in a precinct to an elector thereof; or knowingly swear or affirm falsely upon a lawful examination by or before any registering officer; or make, print, or issue any false or counterfeit certificate of registration or knowingly alter any certificate of registration.

No person shall knowingly register under more than one name or knowingly induce any person to so register.

No person shall knowingly make any false statement on any form for registration or change of registration or upon any application or return envelope for an absent voter’s ballot.

Whoever violates this division is guilty of a felony of the fifth degree.”

700,000 felonies organized is systemic fashion is indeed racketeering and should be prosecuted all the states attorney generals and federal district attorneys in those jurisdictions...

This notes 700,000 individual acts of felonious fraud performed by one organization. This is first degree felony of the highest order under the Racketeering Influenced and Corrupt Organizations Act(RICO). Where are the prosecutors? All fraidy scared of the corrupt democrats about to take over!!!

Here in NW Indiana we know what happens in Lake County Indiana (Gary/Hammond area) originates in Cook County Illinois.

I live just south of you, Daniels is watching this closely according to our county precinct people.

He is going to push hard to nail these false voters.

Remember, registration isn’t voting. We will have to wait until after the election to see how many show up and try to vote with their fraudulent registration.

All I can say is thank God we passed the voter ID laws here.

I worked as a state tax auditor in Lake County for 7 years and I know exactly what you mean. Wasn’t it Robert Kennedy that said Lake County, IN was the most corrupt county in the country?

Can’t you see that it’s all the fault of overzealous rogue operatives on the street level? What could the ACORN leaders do about it? Their hands were tied.

This is just like those thugs in windbreakers and gold chains who brought down the Gambino family, not to mention the janitors who screwed up Enron and Worldcom.

ACORN and the media has been making a big effort to hide how widespread the problem is. You can't really prove racketeering looking at individual cases, because they claim that a few unscrupulous employees were lazy and filled out false application rather than doing their jobs.

However, in the last few months there were 650,000 new voter registrations in Ohio, and there have been problems with over 200,000 of them not matching state and federal databases.

Mistakes happen, so I'm sure there are thousands that are due to incorrectly filled out forms or people not updating their address with the state or federal government. However, when nearly one third are suspect, it's obviously not just a problem of a few mistakes.

There was widespread voter registration falsification. ACORN couldn't have been unaware of such widespread felonious acts by employees. This wasn't the act of just a few people in their employ. A large percentage of their employees were consciously committing multiple felonies daily.

Even if they are telling the truth (which I highly doubt) they had to know that they were not making any significant effort to prevent their employees from such criminal acts in their names.

At best they were aware of it, and did little to stop their employees from doing it.

They should be held to the same standards they would want any other private corporation to be held to. They should be criminally prosecuted, and all assets of ACORN and it's subsidiaries should be seized in order to pay restitution for the expenses their crimes have caused.

Don't forget: The Catholic bishops of the United States, through the "Campaign for Human Development," have been giving money to ACORN for years. AT LEAST SEVEN MILLION DOLLARS. Not only is ACORN a criminal enterprise, it works EXCLUSIVELY for pro-abortion politicians and the HARD, HARD LEFT.

The Catholic bishops of the United States treated the pro-life rescue movement and Operation Rescue like radioactive sewage, and never raised a peep when Bob Dole and Bill Clinton joined hands and crushed the rescue movement with the Freedom of Access to Clinic Entrances Act, an act whose only purpose was the protect the continued slaughter of PEOPLE.
