Berg vs. Obama Update

At 8:55 this evening, and as promised weeks ago, Philip Berg filed a Motion for Extensive and Expedited Discovery in the Philadelphia federal court where, a little more than two weeks ago, he filed suit contesting Illinois Sen. Barack Obama's constitutional eligibility for the presidency.

Per this evening's motion, Berg is seeking results on two fronts: First, that Sen. Obama and DNC Chair Howard Dean sit for depositions at the courthouse in Philadelphia running no less than three hours in length and presided over by a court-appointed Special Master; and second, that the defendants--Obama, the DNC and the Federal Election Commission--turn over documentation connected with the vetting process and the background of the Democratic Party nominee. Upon receiving confirmation that Obama and the DNC have been served with the motion--the U.S. Attorney's office has entered appearance on behalf of the FEC--Berg plans to petition the Hon. R. Barclay Surrick for an immediate telephone conference on the need for the discovery process to begin and move along as quickly as possible.

"In the interest of expediency," Berg said over the telephone as he drove to a air freight depot near Philadelphia International Airport to ensure that the materials were sent to Obama and the DNC as soon as possible, "back when we had the hearing for the temporary restraining order, I asked Judge Surrick if we could have a conference call for expedited discovery, and he said yes. This needs to be handled quickly. Listen, more and more I believe we're correct on this, and if we are then Obama cannot be president, and the United States of America will be headed toward a constitutional crisis."

I think he’s got a case that Obama’s mentally unfit to be POTUS should he decide to go that route.

But his citizenship or the lack thereof is not.

A few weeks ago, when GOP fortunes were at a low ebb, this would have seemed an interesting gambit. Now that Barack’s fortunes are on the wane, do we really want to give the Democrats an excuse to replace BHO with HRC in a Lautenberg for Torricelli type swap?

If it is true that Obama is ineligible to run for the presidency, then he should not be running for the presidency. It establishes a horrible precedent if known and permitted, and if he were to win, it would create a constitutional crisis the like of which has never before been seen.

One would think that Biden would become president, however, if the ticket were a fraud, then there’s no reason to submit to the ascendency of a man who would never have been elected had the constitution been followed.

Does anyone think anything will actually be settled with this? Even if records are produced does anyone actually believe a liberal judge will “thwart the will of the people (democrats/liberals/socialists)”?

Here's the thing: Berg is a fundraiser, friend, and ally of the Clintons. If Obama gets bounced because he has lied about his citizenship, it will be the Clintons who get blamed for exposing him. The overwhelmingly black Democrat party "base" will go ballistic. They couldn't care less about the Constitution or legal technicalities when it comes to race, and they will (correctly) see that Berg's legal proceeding was a scheme by Hillary to bump Obama off the ticket so SHE could take over.


The verdict is read, and OJ Simpson gets away with a double murder.

There was a comment made here at FR regarding Obama having to prove his eligibility before taking the taxpayer’s money for his campaign. If this is true, could that be one of the reasons he opted out?

Sarah Palin seems to have many childhood friends speaking about her. I’ve heard nothing from anyone that seems to know Obama. Maybe this isn’t so ‘off the wall’. If he really is Barak Obama?

You are right on. The Obamessiah is fixing to get crucified by his own people a few days after his triumphal entry.

Operation Chaos must continue! Obama Bin Biden should not be allowed to be substituted out for winners.

Funny how quickly he "learned" to sling mud now that he's loosing.

An HRC supporter heisting the nomination from Obama will cause massive revolt in the Democratic Party.. Turnout will be non-existant and McCain by 20-25%.

You’re crazy if you think HRC bumping BHO out of the nomination would be good for the Dems in November.

They would get their asses handed to them not only in the Presidency but in the US Senate and US House.

An extremely valid concern, but I have to believe that a change of that magnitude (both hugh and series!) would absolutely shatter the democrats, wouldn't it? I mean, look at the Eagleton scenario; the election was a bloodbath.

I don't think the DNC can go back now.
