The two of you are equating criminal behavior with religious faith. The person was arrested for committing a crime. RF's comment was more in line with comments like: "As _____ (fill in the blank) as the prostitute/carjacker/burglar/murderer is, he/she didn't deserve to be beaten like that."

RF's comment was perfectly acceptable.
