This will likely be excluded in the civil trial. It's not relevant.
So...like...he became a munchie?
I'm no lawyer (and didn't stay at a Holiday Inn Express last night), but I believe the drug test results could go to lessening the zoo's responsibility, in the determining an award anyway should the zoo lose. Something about aggravating and/or mitigating circumstances?
Maybe some FReeper legal eagle could comment?
Nah, stoners never give up their stash!
Chalk it up as another ‘marijana related death’. Marijana kills, we have the stats to prove it.
Precisely how I see it. The tiger was a member of an endangered species, and it was just reacting normally to inexcusable taunting by a stupid human that the world is better off without.
Dude, his mellow got hella harshed.
Maybe the M.E. was doing clinical research by sampling the substances and forgot what he or she was doing...for...six...months....
Do I even need to say it?
Not relevant? Of course it is.Just as similar facts would be relevant in a car accident.Driver "A" was sober as a judge and driver "B" wasn't...very powerful stuff.
If I was a juror in this case, hearing of the victim's intoxication,I wouldn't award the plaintiffs a nickel unless I saw irrefutable proof of serious misconduct on the part of zoo staff or of an **obvious** and **glaring** design flaw in the cage.
You apparently don't know many judges.
Apart from that, it isn't the same. The design of the tiger pen was such that it could get out. That is true whether the guy was drunk; or not.
As for your accident example. If one driver is legally drunk, it does not necessarily mean he was at fault. I a drunk is driving through a green light at the speed limit and a sober driver who is not paying attention approaches from the opposite direction and attempts a left turn, who is at fault? The sober guy; of course.
