Libby’s prosecution was payback by Fitzpatrick for Libby beating him in the first Marc Rich trial. It was such a bag job that Denis Collins the Jury Foreman was a personal friend and coworker of Star Witness Tim Russert.

He must have been contacted by the Wilson’s attorney to get the case revived. I wouldn’t doubt if some judge allows it and allows McClellan to be defense witness.
