It's basic law that someone can't be liable for result that isn't legally foreseeable. At the time, the worst anybody thought would happen in a hijacking is that the plane would be diverted to Cuba or somewhere. No one seriously thought hijackers would crash the planes into buildings.

9-11 changed all that, of course.
