Watch out for card-carrying ACLU types like Spitzer---always bleating about "civil liberties." Forget democracy, "tolerant and compassionate" Spitler actually sicced the gov't on his political enemies. Move over Mussolini, make room for Spitler.

Now Spitzer has opened himself up to several charges taxpayers may want to pursue.

EXHIBIT ONE Gov Spitler is failing to act as required when receiving complaints of known incidences of illegal wrongdoing, and by failing to follow government-mandated regulatory reviews.

This is a violation of Penal Law .135.60 COERCION IN THE SECOND DEGREE (a Class A misdemeanor) (covers public officials).

PENAL LAW 135.60 (Committed on or after September 1, 1967) is Coercion in the Second Degree. When an individual uses or abuses his/her position as a public servant by performing some act within or related to his or her official duties, or by failing or refusing to perform an official duty, in such manner as to affect some person adversely. Perform any (other) act which would not in itself materially benefit1the actor but which is calculated to harm another person materially with respect to his or her health, safety, business, calling, career, financial condition, reputation or personal relationships. The term(s), ("crime"), ("public servant") used in this definition has its own special meaning in our law.

EXHIBIT TWO If elected state officials, under oath of office, are aiding and abetting illegals to break US laws, to use phony documents at municipal agencies like the DMV (and if Spitler took campaign contributions from said illegals, and in the process, deliberately ignored US laws in exchange for campaign contributions), this could be characterized as extortion, and/or bribery, and a violation of The Hobbs Act.

EXHIBIT THREE During Spitler's 1998 AG campaign, he indignantly denied allegations by his GOP opponent, Dennis Vacco (a top-notch pro-life conservative), that Spitler's wealthy father had provided millions in loans to his AG campaign.

Candidate Spitzer insisted he was using only his own money (family members are limited by law to $110,000 in total contributions) and accused Vacco of "smearing" his father.

Not until he'd actually taken office did Spitzer admit that Dennis Vacco had been correct, after all. In fact, it turned out Spitzer, despite earlier denials, had done the exact same thing during his unsuccessful 1994 run for AG.

NOTE WELL: Now how did the loving Spitzer family convert all that money to sonny's election? The altruistic Spitzer family runs a "do-good foundation." The IRS has noted that some foundations are prime money laundering vehicles that use phony accounting and fake line items like "LEGAL, CONSULTING AND ADMIN FEES" that are tax evasion schemes. Some foundations also put ghost employees on the payroll to skim off monies.

EXHIBIT FOUR Many states mandate that public officials be bonded (to indemnify taxpayers against government fraud). The acts outlined above would seriously impair Spitzer's ability to be bonded.

TO REPORT:
(1) NY (as in every state) should have an Insurance Fraud Unit.
(2) The NY State AG's office should have an Insurance Fraud Prosecutor.

Spitzer took a wrong turn when he woke up today. And every day of his life. He is a loony leftist who will step in it or have Andrew Cuomo (NY Attorney General) throw it at him.

Spitzer is dangerous and should be in jail.

As I recall, Norman Hsu’s three largest contributions went to Hillary, Cuomo and Spitzer. My question remains, was Norman paying protection to the current and former AG of NY to avoid extradiction to Cal? Seems like a simple question, wonder if any intrepid “JOURNALIST” would persue this line of inquiry?

I live here in NY, and several upstate county clerks have already said they will not process licenses for illegals. The gov’s. policy is an executive order, but carries no force of law; since no legislative action was taken to back it up. The county clerks are under no legal obligation to follow Spitzer’s order. So it may depend on the actual county where this stupidity may or may not occur.

When the Senate’s bill to stop Spitzer’s madness comes up this month watch how many democrats vote for it. Silver in the Assembly has a responsibility to this state to let it come to the floor there also instead of bottling it up as he’s doing now with a bill that passed in June. Or is he afraid of having to put them on record?

When the bill to stop Spitzer’s madness comes up watch how many Democrats vote for it.

My feelings precisely----posted several times.

Anti-illegal is a rare consensus issue that cuts across party lines.

Dem Sen Durbin tried to fault Repubs when he failed to get Amnesty Two (added to the Defense Bill) passed.

Dems are reticent to enact illegal freebies----they are hearing the same anti-ilegal rhetoric from their constituents.

Not sure if Spitler was a typo, but it works for me ;-)

Incidentally, the Albany DA gave the Governor and his aides the go-ahead to use State Troopers to spy on political enemies, saying they hadn't broken the law. Yet the Bush Administration is vilified and sued for wire-tapping our terrorist enemies. HUH? I'm still trying to figure that one out.

I understand. I lived in New York until about a year and a half ago. I glad I didn’t stay in NYS long enough to vote against this nutcase.

Seriously, I don’t think there is anything New Yorkers can do other than hope the State Senate opposes Spitzer.

I wonder how much DA Soares found stuffed in a statehouse urinal for his trouble? Maybe Daddy Spitzer altruistically had his "Foundation" help out "the little children." (sob)

The NY Post reported Sept 25 that allegations of collusion between the gov's office and the Albany DA surfaced. In one account, NYP state editor Fred Dicker disclosed that Soares let Spitzer's top aides "review and edit" sections of the DA's report before he released it Friday........that could explain why the report gave Spitzer & Co. a clean bill of health.

In another report NYP State Editor Dicker had Spitzer insisting he didn't know anything about late-night "black car" meetings held by his senior aides to prevent the creation of records that could be subpoenaed in the state dirty-tricks political scandal.

Seems N.Y. elects more then its share of very ignorant or stupid politicians.
Here in Florida things aren’t a lot better what with Mel Martinez and this nimrod crist as governor but we just don’t have the shear numbers of dumbasses in office as N.Y. does.
Schumer, cuomo, Clinton, Spitzer, and the list can go on and on and on.

If I'm not mistaken, Soares is a Democrat, and it was highly doubted he'd do a thorough investigative job, and they're saying, the newly-appointed State Ethics Commission will probably whitewash the whole thing too. I had heard about the secret meetings held in cars to avoid any email and phone call trails. I hadn't heard or recall reading that Spitzer's aides were allowed to edit the DA's final report. Thanks for sharing that. It doesn't surprise me. If I recall correctly, he didn't subpoena any public officials or require depositions under oath. If he wasn't going to vigorously pursue evidence, I wonder why he even bothered to open the investigation to begin with.

I'm a little perplexed that the Acting Superintendent of the State Police, Preston L. Felton, has literally been untouched in all of this. He was the one who had to approve the use of troopers to spy on Bruno. Cuomo recommended he be disciplined, but Spitzer said he wouldn't touch him. I'm sure Spitzer's motive was to retain Felton's silence on the scandal. Preston stands to become the first black Superintendent of the State Police. Spitzer appointed him Acting Supt. when he took office earlier this year. I guess I shouldn't be surprised that he slipped through the cracks. I worked for NY State Corrections, in uniform for 23+ years. I saw many people fired for less than what Preston is guilty of. As we used to say in the prison system: "It's not who you know, it's who you blow." I'm sure whatever standing this guy once had with his fellow troopers has now been permanently damaged. I can't imagine the remainder of his career being very fulfilling. He'd be better off retiring while he's still ahead.

SCHOHARIE _ Sen. James Seward and Assemblyman Pete Lopez, R-Schoharie today joined Schoharie County and other area officials and in calling on Gov. Eliot Spitzer and the Department of Motor Vehicles to immediately rescind a policy that allows illegal aliens to obtain driver's licenses, or face a lawsuit.

Lopez and Seward maintain that the governor and the DMV commissioner are in direct violation of state law, which requires a Social Security number be provided to obtain a driver's license (Section 502, subsection 1 of the Vehicle and Traffic Law).
