Since the CIR drafters are so intent at giving amnesty to illegals while closing all practical roads to legal immigration, wiping out all hope of those that patiently done all by the book, whether American on legal immigrant:

Draft Bill Proposal

International Divorce Immigration Relief Act (IDIRA)

The purpose of this law is to allow children regular, meaningful contact to both parents, also where families become separated over international boundaries in times of globalization. It also improves the ability of parents to financially support children legally residing in the United States, for example, allowing a parent living in a underdeveloped country with low pay to help in the upbringing of the minor child.

This is not over yet. Bush refuses to give up this easily. It's his stuborn character. He will try to resurect it and call it something else. We have to keep our guard up. We need to keep the pressure up.

STAGE TWO is to go after the people who hire illegals. Start giving them fines and arresting them. Just catch ten or 100 of them on the nightly news. The magnet will dry up and most of the 12 million will go home by themselves.

As an adendum, we should anonymously call the IRS, people working "off the books" means taxes ain't being paid. Make anonymous fliers and hang them around the neighborhood, name names. It's time to embarras these bustards, whether they give to the GOP or Rats, we don't need them.

STOP AMNESTY NOW!! WE CAN DO IT!!

CALL! CALL! CALL! CALL! AND KEEP CALLING TILL THE LINES FRY!

WRITE! WRITE! WRITE! WRITE! TILL YOU RUN OUT OF INK IN YOUR PEN!

Bombard the Democrats as well, especially the ones that ran on an anti illegal immigration plank and the ones in marginal districts who could be vulnerable. keep pounding on them. This is a bipartisan issue not a Conservative or Liberal issue BUT AN AMERICAN issue.

First, I am a white man from a rich country, so I am not from a 3rd world country. However, as I demand fairness, and I demand those family values the US is so often proclaiming, it must be children first. And indeed, a parent in my shoes who would have legally returned to say Botswana would have no hope to make enough money there to support a child lost in divorce never to be seen again. This is not fair. Now compare to what the CIR does for illegals. So please don’t say this is non-sense.

Yes, I am being honest. I am culturally no conservative. I am no American.
I realized though that the Democrats will screw over law-abiding people. That doesn’t make me automatically a Republican if they are part of the deal and for other reasons. One of which is I am no American.
I have an American daughter though.
And I lived through East German communism. I know what it is to be separated from family because of politics.
I know there are people here who oppose all immigration, maybe you are one of them. There are probably also people who oppose illegal immigration only. There are those people on all sides of political aisles. Just that legal immigration is railroaded by this CIR. I am a lone fighter and need to awake people on all sides.
As for father’s rights, probably the liberals are also the ones not on my side. This is also a father’s rights issue. But of course I can’t be for father’s rights alone. This is about the right of international children (most often, from US/international couples).

Here for all of you Freepers who are for honesty and fairness.

I came to be on H1B after receiving a US PhD. Not some Indian body shoppers employee, but doing hands-on research in indeed low-paying postdoctoral jobs at university.

You may not know, but the H1B is tied to the employer and to the particular pay. So if research money is gone, the visa is gone. Every time this is anticipated, one has to scramble to find another employer to apply for a new visa. Before that new visa arrived, one cannot work. One cannot travel abroad (e.g. to see family). A total of 6 years is possible.

There are caps on the new H1B issued each year. Extensions and exempt, but for new ones (which is what I would need) the cap is reached within ONE day. This is due to mass-importing companies.

Only private corporations can sponsor a switch from H1B to Green Card. While waiting for such Green Card, one has to continue getting another H1B from that employer if 6 years are over. Aagin, tied to the employer. If the company goes out of business, all is lost.

There are also no grace periods. If no work, H1B is invalid, and 24 hours to leave.

Now imagine having a pregnant wife at that time. Going home all the time saying no, no new position yet, just a few weeks left ....

Meanwhile, illegal immigrants just smile and go to some other slave holder.

What does CIR propose besides the amnesty for illegals (the amendments are mainly from Sanders and Democrats, with Republicans often consenting):

> H1B cost 5000 to 10000 dollars more to the employer - each time (also for renewals and extensions), and perhaps only for 1 year maximum each renewal

> if corporate H1B employer closes down a factory and its employees are laid off, then within 60 days all H1B will lose visa and company may not petition for any immigrant visa (H1B/GC) anymore. Well, this might mean the company cannot design new products anymore and will go oversees.

> H1B is granted only after proof no American applied for a widely advertised position (making it equally difficult as the Green Card while it is no Green Card)

> H1B may not be dual intent anymore, that is will not allow going for Green Card

> Total number of Green Cards for skilled employment and for family goes down.

> Green Card lottery abandonded.

> Visa waivers (2 year foreign residency requirement) after non-immigrant J1 student/postdoc visa not granted anymore, meaning no switching from J1 to H1B.

> tourist visa waivers for friends of the US are in peril, meaning all tourists will have to do visa interviews and males need people to vouch for them. Now I will even be suspicious for having a daughter in the US (could cause me to overstay ...) Besides, that will hit the US tourism industry hard.

So while Kennedy & Co go to extreme measures to ensure all the illegal immigrants can stay with no questions asked and a one-time (!) penalty of $5000 and their families will remain intact, those that followed the laws are screwed.

Is that American fairness? Is that the country my daughter will grow up calling her home country?

Besides, as opposed to many illegals I paid all taxes, FICA etc (never of any use for myself).

What are my chances to move back to the US? Zero absolutely zero! Of course I am enraged. I don’t even talk to my daughter on the phone anymore given the huge time difference. She is little and won’t know, and mom’s happy I am gone.

But to be fair, I want Americans to have the same rights in Germany that I want for myself in the US.

Thank you for your honesty and passion.

Do you consider YOURSELF an American or a German?

Most of us would like to see the legal spigot opened a little bit, particularly for H1B’s. However, we are a nation of laws under a Constitution, so it might be a bit rough on you for awhile. We gave our Senate a beatdown a few days ago, and, once the existing laws are followed, with a secured border, your case will likely gain some administrative sympathy.

Until then, yes, rip on the American Body Politic. That’s what it’s there for.

(sorry, dear monitors, I forgot another important point in the CIR, the merit point system)

I personally will have no chance getting in this way either: losing points for my age, not having immidiate previous employment in the US (as I am no H1B anymore).

Enough ranted. Please Reader understand why I am enraged. Besides - this happens also with American kids born overseas, brought back to the US after divorce. So it has nothing to do with me having married another German. Green Cards for marrying Americans are also temporary - it can happen there too and I know cases.

And please, to all of you, please do not believe that H1B do not pay taxes! I know Lou Dobbs said that. In fact, some F1 and J1 under specific conditions (bilateral agreements with other countries) do not pay part of their taxes - in exchange for Americans being treated the same way in that country. Once beyond a certain amount of time in the US, the federal IRS considers them tax residents and they have to pay all taxes and sometimes the taxes not paid before because of the treaties. In addition, once tax resident or under H1B, all social security taxes are paid. This is because H1B is dual intent, that is one day one may become a citizen and then one may also get benefits. However, that chance is remote.
Because some states do not see any H1B or temporary worker as residents, state taxes are even higher than for citizens. There are no credits for owning a house or moving costs, for example, in Wisconsin.

It is also not seen good to switch back from H1B to some other visa. Once dual intent one should stay there. The whole system is set up that one has a high chance to fail, and will not get another. I can understand the illegals won’t take such chances if you tell them to go back and try the legal way if the legal way can be personal destruction.

I don’t know if I reposted that the future merit based system also is difficult for many reasons. For example, I myself lose points for my age. I lose points for having left before implemented. I get no points for having a citizen daughter, while an adult will get points if having a citizen parent. A tremendous number of people who filed the last few years for family or employment based Green Cards will just lose all achieved in that application, including lawyer fees, and start over under a more difficult point system with again many years of backlog.

There is only one thing - if the CIR is rising again from the dead because this is the will of Bush and Democrats , both illegals and legals and Americans who had applied for family members must be treated equally. Or let the illegals feel for once what it is like following rules and not be rewarded for it.

Not at all... but since wages are lower there (because Americans are evil greedy capitalists),
and government want all children to have everything all the time (not because government is interested in control and influence, but merely because they're, gosh, just so darn compassionate),
Americans must be punished, to help those who have broken US laws.

What's so hard to understand about that? It seems perfectly just and righteous to everyone in France.

Ah, but this is part of the problem, my friend. Many want these incredibly bad amnesty rules passed, and they intentionally try to confuse legal immigrants with those who do not do any of the work that you did. I know a few people who have been waiting for 7-8 years for permission to stay here for 2-3 years for a degree or a job. We WANT as many of those folks as we can get. It is the vast number of ILLEGAL immigrants that we want to see removed, until they follow proper procedures, as you have.

I'm sure there are numerous small problems with our legal immigration system (including the quotas, etc), but those have nothing to do with the reason most Americans are screaming right now at their Senators. We want those who follow the rules (as you did) to be rewarded, and those who do not to be punished. For some unknown reason, our leaders cannot grasp this very simple concept.

There is no reason that a Mexican who swam across the Rio Grande should be given better treatment than you or any other person who followed the rules... and yet that is exactly what many of our leaders are trying to do.
