If the puking didn't help sober her up, the shower certainly should have.

It's a moot point, because drunken men cannot perform, no matter what the judge rules.Yea, right! ROFL!

Okay, but if the puking and the shower DID sober her up, then she's not being truthful when she says the next thing she remembered was that he was having sex with her. Seems to me there is something missing in her story.

I've always disagreed with the premise that a man and a woman can drink together, both get equally drunk, have consensual sex, and then the next day he can be charged with rape because she was not legally responsible for her actions but he was.
To: cammie
Oh, yes; we also forgot the sobering, cool February night walk home, before the puking, that led to the shower.
Probably a LOT missing from the story.
It has been many decades, but I seem to remember a point where seeming lucidity returned for a while, before the haze re-descended prior to sleeping it off.
Not everything done in that "lucid" period was always remembered without outside help.

"Sir Igor Judge, sitting with Lady Justice Hallett and Mrs Justice Gloster, said sex would amount to rape if the complainant had lost her capacity to choose as a result of drink.
"However, where the complainant has voluntarily consumed even substantial quantities of alcohol, but nevertheless remains capable of choosing whether or not to have intercourse, and in drink agrees to do so, this would not be rape," he said. "
phew!
I've been on pins and needles over this decision - wondering if I was married to a "rapist" after what happened that night we went to the winery.
Ok...hubby is in the clear.

Alcohol is in your bloodstream or it isn't. Puking and showering might make someone (very temporarily) more wakeful, but the only way to get alcohol out of your bloodstream is time (and maybe exercise).

Except she claimed not to have ever consented to the act. The alcohol is irrelevant. It's a he said/she said thing.

I disagree with that premise too, but that's not what usually happened when a woman claims she was raped, and a man claims she consented.

I have not read this article, but the answer is obvious. Of course they can!
And sometimes they bring the bottle of wine along with them.

One must remember that the high tax rates in England are scaring away their best and brightest men. The judges had to come up with *some* justification why men should stay under Her Majesty's crown. Shrewd move, Brits! Decadent but shrewd.

then he too moved on to vodka and Red Bull. I'd sentence him to 30 days just for his choice of drink.

Hey don't discriminate! Its not just for the ugly, or it is, or we are all, or we are not, or have been at some point, or will be in the future.

Decision sounds about right. Drunken idiocy is one thing and rape is entirely another...

So are you saying you think it is right that you can fill any girl up with tons of booze so you can get in her pants? I bet you would not say that if you had a daughter in her late teens or early twenty's
